Abstract

The global persecution of Christians is an urgent human rights issue that remains underreported. This volume presents the results of the first systematic global investigation into how Christians respond to persecution. World-class scholars of global Christianity present first-hand research from most of the sites of the harshest persecution as well as the West and Latin America. Their findings make clear the nature of persecution, the reasons for it, Christian responses to it - both non-violent and confrontational - and the effects of these responses. Motivating the volume is the hope that this knowledge will empower all who would exercise solidarity with the world's persecuted Christians and will offer the victims strategies for a more effective response. This book is written for anyone concerned about the persecution of Christians or more generally about the human right of religious freedom, including scholars, activists, political and religious leaders, and those who work for international organizations.

Abstract

Religious liberties are at the centre of many debates on how liberal democratic societies can accommodate diversity. This book considers the interaction between law and religion from a broad international, comparative and jurisprudential perspective and proposes a new theoretical approach to religious liberty that both transcends and transforms current approaches to religious rights. Not only does the discussion draw on the work of a range of legal and political philosophers including John Rawls, Ronald Dworkin and John Finnis, it also tests the validity of the various proposals against actual 'hard cases' derived from multiple jurisdictions. In so doing, the analysis overcomes longstanding challenges to existing religious rights regimes and identifies a new theoretical paradigm that specifically addresses the challenges associated with religiously pluralist societies. Through this type of interdisciplinary analysis, the book identifies a religio-legal system that both religious and non-religious people can support.

Abstract

Generations of festering culture wars, compounded by actual wars in predominantly Muslim countries, the terrorism of Isis, and the ongoing migrant crisis have all combined to make religious discrimination the most pressing challenge now facing many governments. For the leading common law nations, with their shared Christian cultural heritage balanced by a growing secularism, the threat presented by this toxic mix has the potential to destabilise civil society. This book suggests that the instances of religious discrimination, as currently legally defined, are constrained by that cultural context, exacerbated by a policy of multiculturalism, and in practice, conflated with racial, ethnic or other forms of discrimination. Kerry O'Halloran argues that many culture war issues - such as those that surround the pro-choice/pro-life debate and the rights of the LGBT community - can be viewed as rooted in the same Christian morality that underpins the law relating to religious discrimination.

Abstract

To allow or restrict hate speech is a hotly debated issue in many societies. While the right to freedom of speech is fundamental to liberal democracies, most countries have accepted that hate speech causes significant harm and ought to be regulated. Richard Moon examines the application of hate speech laws when religion is either the source or target of such speech. Moon describes the various legal restrictions on hate speech, religious insult, and blasphemy in Canada, Europe and elsewhere, and uses cases from different jurisdictions to illustrate the particular challenges raised by religious hate speech. The issues addressed are highly topical: speech that attacks religious communities, specifically anti-Muslim rhetoric, and hateful speech that is based on religious doctrine or scripture, such as anti-gay speech. The book draws on a rich understanding of freedom of expression, the harms of hate speech, and the role of religion in public life.

Abstract

In Freedom of Religion and Its Regulation in Nigeria: Analysis of Preaching Board Laws in Some States of Northern Nigeria , Ahmed Salisu Garba provides an account of how states in Northern Nigeria have enacted laws to regulate religious preaching in the spheres of influence. The work examines the debates surrounding the laws and how the state in collaboration with dominant religious groups persecuted members of minority religious in the states. The author applied an argumentative approach to raise and analyse issues relating to the reasonability of the laws in Nigeria, reasons for their enactment, judicial review mechanisms employed in the determination of the reasonability of the laws in democracies, and how they accord with the freedom of religion clause in the Nigerian Constitution.

Abstract

Religious terrorism poses a significant challenge for many countries around the world. Extremists who justify violence in God's name can be found in every religious tradition, and attacks perpetrated by faith-based militants have increased dramatically over the past three decades. Given the reality of religious terrorism today, it would seem counterintuitive that the best weapon against violent religious extremism would be for countries and societies to allow for the free practice of religion; yet this is precisely what this book argues. Weapon of Peace investigates the link between terrorism and the repression of religion, both from a historical perspective and against contemporary developments in the Middle East and elsewhere. Drawing upon a range of different case studies and quantitative data, Saiya makes the case that the suppression and not the expression of religion leads to violence and extremism and that safeguarding religious freedom is both a moral and strategic imperative.

Telle a été la question complexe étudiée lors du colloque dont le présent volume recueille une sélection de communications. Délibérément attachés à l'étude des sources religieuses de la liberté de conscience, les textes ici réunis constituent autant de contributions à l'étude de la part du fait religieux dans l'émergence de la liberté de et des consciences, c'est-à-dire, aussi bien dans l'acception subjective que dans l'acception objective de cette liberté.Dans une perspective résolument orientée en diachronie longue, l'ouvrage met au jour les questions récurrentes et leur évolution ; les courants religieux favorisant l'individualisme et le contact personnel avec le monde divin ; les médiateurs (prédication, images religieuses, imprimé...); les points d'application dans la société sur les plans religieux et politique ; les discours et modalités énonciatives selon lesquels se développe le for intérieur, de manière à moduler l'affirmation d'une subjectivité spirituelle autonome.
