Abstract

This book explores the judicial treatment of suicides in early modern Sweden, with a focus on the criminal investigation and selective treatment of suicides in the lower courts in the seventeenth and early eighteenth centuries. Riikka Miettinen shows that reactions and attitudes towards suicides varied considerably despite harsh condemnation by officials. The indictment, investigation, and classification of suspected suicides and the mental state of a person already deceased were challenging, and depended on local co-operation and lay testimonies. Not all suicides were considered alike; a widespread view on the heinousness of suicide was not the same as agreement about specific cases, and did not result in uniform handling of them. The social status and local ties of the deceased influenced the interpretations and responses at the local lower courts and communities. Esteemed local community members had a better defence and greater chance to escape the shameful penalties.

"Suicide prevention initiatives are part of much broader systems connected to activities such as the diagnosis of mental illness, the recognition of clinical risk, improving access to care, and coordinating with a broad range of outside agencies and entities around both prevention and public health efforts. Yet suicide is also an intensely personal issue that continues to be surrounded by stigma. On September 11-12, 2018, the National Academies of Sciences, Engineering, and Medicine held a workshop in Washington, DC, to discuss preventing suicide among people with serious mental illness. Exploring the failure of hospice in America to care for patients and families at the end of life.Hospice is the dominant form of end-of-life care in the United States. But while the US hospice system provides many forms of treatment that are beneficial to dying people and their families, it does not encompass what is commonly referred to as long-term care, which includes help with the activities of daily living: feeding, bathing, general safety, and routine hygienic maintenance. Frequently, such care is carried out by an informal network of unpaid caregivers, such as the person's family or loved ones, who are often ill-prepared to offer this type of support.In The Crisis of US Hospice Care, Harold Braswell argues that the stress of providing long-term care typically overwhelms family members and that overdependence on familial caregiving constitutes a crisis of US hospice care that limits the freedom of dying people. Arguing for the need to focus on the time just before death, Braswell examines how the relationship of hospice to familial caregiving evolved. He traces the history of hospice over the past fifty years and describes the choice that people dying with inadequate familial support face between a neglectful home environment and an impersonal nursing home.A nuanced look at the personal and political dimensions that shape long-term, end-of-life care, this historical and ethnographic study demonstrates that the crisis in US hospice care can be alleviated only by establishing the centrality of hospice to American freedom. Providing a model for the transformative work that is required going forward, The Crisis of US Hospice Careillustrates the potential of hospice for facilitating a new way of living our last days and for having the best death possible.

Abstract

Si Montaigne continue de nous exhorter, lui qui voulait une « mort molle et douce » mais, plus que tout, une « mort toute mienne » (Essais, III, 9), notre rapport à la mort reste aujourd’hui toujours difficile et apparaît souvent comme paradoxal : le (devenu) consensuel « droit à (se laisser) mourir » n’équivaut pas au « droit à la mort », qui sonne comme une scandaleuse provocation revendicatrice. Le présent ouvrage liste les arguments aptes à soutenir que, dès lors qu’on n’a pas demandé à vivre, la question du choix des conditions et du moment dignes où l’on souhaite mourir constitue la première liberté de tout individu autant qu’un droit qui doit lui être reconnu. Il examine donc dans le détail, à travers de nombreux exemples concrets et historiques, l’appréhension faite « en droit » (mais au travers aussi de la sociologie, la philosophie ou la psychologie) de toutes les morts : du suicide à l’euthanasie volontaire, en passant par les questions sensibles de l’avortement, de l’euthanasie du foetus, de l’eugénisme, du « droit de ne pas naître », de celui de se laisser mourir et du suicide assisté (ou euthanasie par compassion). Il ne fait pas non plus l’impasse sur les suicides lents (drogues douces légalisées), déguisés (activités à risque) et les autres comportements antisociaux par « punition de soi-même » ou « mépris de soi ». Et il se clôt sur les raisons de souscrire à ce droit émergent : celui, pour chacun, de pouvoir librement choisir sa mort.
