Comment un arrêt de la Cour constitutionnelle ouvrant la possibilité d'interdire le hijab dans l'enseignement supérieur a-t-il mis le feu aux poudres, provoquant des guerres larvées ou ouvertes entre des partis politiques, des journalistes, des associations, des académiques, impliquant le Parlement bruxellois, le Conseil de l'Europe, la Commission européenne ? L'étincelle ? Un «bout de tissu» : le hijab. La mèche ? Une opération de victimisation sur le dos d'un camp laïque qui peine à émerger dans la capitale européenne, où le vote musulman semble faire tourner la tête des notables de la ville. Accusations de harcélement, doxing, censure, cancel culture, etc. Bruxelles s'enflamme, à sa manière, autour de la laïcité. Cette laïcité à la belge serait-elle désormais appelée à représenter autre chose qu'un pilier tranquille ? Des chercheurs, travailleurs sociaux, journalistes et élus osent aujourd'hui lever le voile sur les atteintes à la liberté d'expression et de conscience dans la capitale européenne

Abstract

Ce travail de fin d’études aborde les enjeux d'une relation tendue entre la presse et la justice. Il consacre plus particulièrement l’étude de la communication du ministère public vers les médias, récemment réglementée par la COL OMP 1/2019. Malgré son objectif de transparence et d’ouverture au public, cette circulaire a fait l’objet de vives réactions de la part des journalistes qui l’ont qualifiée d’acte inacceptable de « censure ». Alors qu’une évaluation doit prochainement avoir lieu, ce travail tente d’éclairer le débat à travers l’article 10 de la Convention européenne des droits de l’homme. 
Après avoir planté le décor des enjeux et des règles de communication en vigueur, le cœur de la problématique est soumis à l’examen de la jurisprudence de la Cour européenne des droits de l’homme. Les arguments soutenant la censure de la presse sont mis en balance avec ceux démontrant la non-violation de liberté d’expression ; l’objectif n’étant pas de trancher le débat mais de poser des balises et lever les points d’attention nécessaires lors de la mise en œuvre de certains articles de la circulaire.

Abstract

"Qu’elle provienne du Canard enchaîné, des Guignols de l’info ou de Dieudonné, la satire frappe et scandalise. Elle bouscule les normes sociales et dérange le politique en usant d’armes singulières : le comique, l’exagération et la caricature. Distincte du simple pamphlet, elle est d’abord un genre littéraire et artistique dans lequel le satiriste oppose ses valeurs morales à une réalité qu’il juge absurde. Les attentats contre Charlie Hebdo de 2015, les polémiques à répétition au sujet de dessins de presse et de certains registres humoristiques révèlent que la satire se situe sur une ligne de crête : dénonçant les travers de la société ou le ridicule de certains comportements, elle est souvent accusée de mépriser les plus faibles et de tourner en dérision les choses les plus sacrées. En réunissant historiens, juristes, philosophes, politistes, sociologues et linguistes, cet ouvrage offre un large regard sur la pratique satirique, sur les contraintes qui l’entourent et les conditions qui la rendent possible, notamment les contours de la liberté d’expression. Il examine la façon dont la satire se construit entre conventions artistiques et règles juridiques, comment elle a évolué dans ses formes, ses contenus et ses stratégies depuis le XIXesiècle jusqu’à ses usages politiques récents, en particulier pendant les élections présidentielles de 2017. Abstract

Following the assassination of Henri IV in 1610, the political turbulence of Louis XIII's early reign led to renewed efforts to police the book trade. Yet this period also witnessed a golden age of so-called 'libertine' literature, including a plethora of sexually explicit and irreverent poetry as well as works of free-thinking that cast doubt on the dogma of Church and State. As France moved closer towards absolutism, a number of unorthodox writers were forced to defend themselves before the law courts. Libertines and the Law examines the notorious trials of three subversive authors. The Italian naturalist philosopher Giulio Cesare Vanini was brutally executed for blasphemy by the Parlement de Toulouse in 1619. The Jewish convert Jean Fontanier was burned at the stake two years later in Paris for authoring a text refuting Christian teaching. Finally, the trial of the infamous poet Theophile de Viau for irreligion, obscenity, and poetic descriptions of homosexuality proved to be a landmark in French literary and social history, despite the poet eventually escaping the death penalty in 1625. These trials are contextualised with a conceptual history of libertinism, as well as an exploration of literary censorship and the mechanics of the criminal justice system in early modern France. Drawing from rarely explored archival sources, newly discovered evidence, and legal manuals, Libertines and the Law provides new insights into the censorship of French literature and thought from the perspectives of both the defendants and the magistrates. Through a diverse corpus including poetry, philosophical texts, religious polemics, Jewish teachings, and private memoirs, it sheds new light on this crucial period in literary, legal, and intellectual history.

La liberté académique, essentielle au développement du savoir, est menacée dans le monde entier et en France en particulier. C’est ce qu’explore ici magistralement Olivier Beaud, à la fois par une réflexion sur la notion de liberté académique, très mal connue en France, et une enquête sur les menaces qui la visent. Consubstantielle à l’idée même d’université moderne, cette notion se distingue de la liberté d’expression, ce que nous rappellent deux événements historiques, le maccarthysme aux États-Unis et Mai-68 en France, au cours desquels la liberté académique s’est trouvée fort malmenée. Mais le plus urgent est encore de prendre la mesure des menaces qui pèsent lourdement aujourd’hui sur la liberté académique, qu’elles proviennent de pouvoirs « classiques » (politique, administratif et économique) ou de « nouveaux » pouvoirs résultant de la lutte contre le terrorisme, de l’utili­sation abusive d’internet et de la promotion des causes identitaires, visibles dans le mouvement de la cancel culture. Ce livre démontre que de telles menaces dépassent la seule question de l’islamo-gauchisme qui a accaparé à tort l’attention des médias. À travers l’examen de ces inquiétantes dérives, cet ouvrage est un plaidoyer vibrant et documenté en faveur du métier de professeur d’université

Abstract

Homme de théâtre russe, universellement connu pour sa méthode de formation de l’acteur « le Système », co-fondateur et directeur du Théâtre d’Art de Moscou, acteur, metteur en scène, pédagogue, Konstantin Stanislavski (1863-1938) a laissé une importante correspondance qui témoigne de son trajet théorique et de sa longue pratique théâtrale. Les lettres ici présentées révèlent d᾿abord son infatigable curiosité qui le pousse à rencontrer les artistes les plus divers pour apprendre auprès d᾿eux, discuter de son approche du théâtre et du jeu. Grâce aux tournées internationales du Théâtre d᾿Art en 1906 et 1922-1924, sa renommée s᾿étend et les échanges se multiplient avec Craig, Duncan, Gémier, Hébertot, Maeterlinck, Reinhardt. La correspondance permet de découvrir aussi les sacrifices personnels consentis au nom de la grande œuvre : la création, l᾿administration, et la transmission du Théâtre d᾿Art de Moscou. À cet égard, les échanges avec l᾿autre directeur du Théâtre, Nemirovitch-Dantchenko, en disent long sur les difficultés de la cohabitation : pendant quarante ans, les deux directeurs ont tant bien que mal maintenu le cap dans les tempêtes des révolutions et des guerres,et ils ont réussi à sauver leur théâtre, au départ privé, puis nationalisé en 1919. Les lettres de Stanislavski permettent de suivre pas à pas la soviétisation de la compagnie qui faillit disparaître au début des années vingt comme bastion de l᾿art bourgeois mais qui fut choisie par Staline pour servir de modèle à toute l᾿URSS. Enfin, les lettres de Stanislavski racontent les angoisses de l᾿écriture du Système, les pressions idéologiques, les difficultés terminologiques, surmontées par la certitude que l᾿expérience d᾿une vie dans l᾿art servira d᾿exemple et enrichira les futurs comédiens.

A Dominican-born academic tells the story of how the Great Books transformed his life—and why they have the power to speak to people of all backgroundsWhat is the value of a liberal education? Traditionally characterized by a rigorous engagement with the classics of Western thought and literature, this approach to education is all but extinct in American universities, replaced by flexible distribution requirements and ever-narrower academic specialization. Many academics attack the very idea of a Western canon as chauvinistic, while the general public increasingly doubts the value of the humanities. In Rescuing Socrates, Dominican-born American academic Roosevelt Montás tells the story of how a liberal education transformed his life, and offers an intimate account of the relevance of the Great Books today, especially to members of historically marginalized communities.Montás emigrated from the Dominican Republic to Queens, New York, when he was twelve and encountered the Western classics as an undergraduate in Columbia University’s renowned Core Curriculum, one of America’s last remaining Great Books programs. "Well into its third decade, the military conflict in the Democratic Republic of the Congo has been dubbed a "forever war"--A perpetual cycle of war, civil unrest, and local feuds over power and identity. Millions have died in one of the worst humanitarian calamities of our time. The War That Doesn't Say Its Name investigates the most recent phase of this conflict, asking why the peace deal of 2003--accompanied by the largest United Nations peacekeeping mission in the world and tens of billions in international aid--has failed to stop the violence. Jason Stearns argues that the fighting has become an end in itself, carried forward in substantial part through the apathy and complicity of local and international actors. Stearns shows that regardless of the suffering, there has emerged a narrow military bourgeoisie of commanders and politicians for whom the conflict is a source of survival, dignity, and profit. Foreign donors provide food and urgent health care for millions, preventing the Congolese state from collapsing, but this involvement has not yielded transformational change. Stearns gives a detailed historical account of this period, focusing on the main players--Congolese and Rwandan states and the main armed groups. He extrapolates from these dynamics to other conflicts across Africa and presents a theory of conflict that highlights the interests of the belligerents and the social structures from which they arise."--
