Abstract

This book compares Islamic and Western ideas of human rights in order to ascertain which human rights, if any, can be considered universal. This is a profound topic with a rich history that is highly relevant within global politics and society today. The arguments in this bookare formed by bringing William Talbott's Which Rights Should Be Universal? (2005) and Abdulaziz Sachedina's Islam and the Challenge of Human Rights (2014) into conversation. By bridging the gap between cultural relativists and moral universalists, this book seeks to offer a new model for the understanding of human rights. It contends that human rights abuses are outcomes of complex systems by design and/or by default. Therefore, it proposes that a rigorous systems-thinking approach will contribute to addressing the challenge of human rights. Engaging with Islamic and Western, historical and contemporary, and relativist and universalist thought, this book is a fresh take on a perennially important issue. As such, it will be a first-rate resource for any scholars working in religious studies, Islamic studies, Middle East studies, ethics, sociology, and law and religion.

“This book offers valuable insights into the development of human rights norms and mechanisms in ASEAN, stressing the role of regional non-state actors, who are often neglected in the literature on ASEAN regionalism. It makes an important contribution to the growing complexity of ASEAN studies, to the study of human rights, as well as to the Constructivist literature on norm diffusion from a non-Western perspective.” – Amitav Acharya, American University, Washington, D. C., USA This book explains how the ASEAN regional human rights body (AICHR) was created and why it functioned with a promotional rather than protection mandate. It does this by positioning itself within a sizable literature on norm diffusion, and introduces the concept of “Norm Interpreters” to explain what happens when global human rights norms are adopted/adapted within a local context, particularly highlighting the role of a group of individuals in the process. In this respect it adds to the International Relations literature on norm diffusion and the Southeast Asian region specific literature on ASEAN regionalism and AICHR. Der Fall Colonia Dignidad ist eines der dunkelsten Kapitel der bundesdeutschen Geschichte und bis heute in großen Teilen nicht aufgearbeitet. In der von deutschen Staatsbürgern in Chile gegründeten Siedlung wurde zwischen 1961 und 2005 missbraucht, misshandelt, gefoltert und gemordet. Medien und Menschenrechtsorganisationen berichteten früh darüber, das Auswärtige Amt und die bundesdeutsche Justiz schritten jedoch nicht ein. Jan Stehle hat hierzu in umfangreichen Recherchen Primärquellen aus Behörden- und Privatarchiven erschlossen. Er rekonstruiert detailliert die Verbrechen sowie das respektive Behördenverhalten und legt die Mitverantwortung von Bundesbehörden für die schweren Menschenrechtsverletzungen der Colonia Dignidad offen.
