Abstract

This book examines the importance of international criminal law in promoting and defending human rights as well as its relationship with law and international politics. It highlights criminal cases at the International Criminal Tribunals for the former Yugoslavia and the International Criminal Tribunals for Rwanda, the International Criminal Court, and the International Crimes Tribunal of Bangladesh. The book considers human rights approaches to crimes from a theoretical and practical perspective, analyses various crimes under international law, and examines the application, implementation and enforcement of international criminal law. This book will serve as an important reference for students, teachers, scholars and lawyers specialising in international human rights, international criminal law and international humanitarian law.

Abstract

The outline of this chapter is as follows. In section 2 we provide a further definition of PTs, and present some possibilities that PTs offer for the smart correctional rehabilitation of criminal offenders. Next, in section 3, we briefly discuss the right to mental liberty and the extent to which this right is guaranteed by existing European human rights. In section 4, we discuss three considerations that should be relevant in specifying human rights protection against smart rehabilitation. Subsequently, in section 5 we explore whether the use of PTs in the context of smart rehabilitation would infringe an appropriately specified legal right to mental liberty. We suggest that, in this context, it might be difficult to identify compelling distinctions between novel forms of smart rehabilitation and more traditional criminal legal interventions, such as the imposition of a prison sentence or a psychological treatment program.

Abstract

How the American High Commissioner for Germany set in motion a process that resulted in every non-death-row-inmate walking free after the Nuremberg trialsAfter Nuremberg is about the fleeting nature of American punishment for German war criminals convicted at the twelve Nuremberg trials of 1946–1949. Because of repeated American grants of clemency and parole, ninety-seven of the 142 Germans convicted at the Nuremberg trials, many of them major offenders, regained their freedom years, sometimes decades, ahead of schedule. High-ranking Nazi plunderers, kidnappers, slave laborers, and mass murderers all walked free by 1958. High Commissioner for Occupied Germany John J. McCloy and his successors articulated a vision of impartial American justice as inspiring and legitimizing their actions, as they concluded that German war criminals were entitled to all the remedies American laws offered to better their conditions and reduce their sentences. Based on extensive archival research (including newly declassified material), this book explains how American policy makers’ best intentions resulted in a series of decisions from 1949–1958 that produced a self-perpetuating bureaucracy of clemency and parole that “rehabilitated” unrepentant German abettors and perpetrators of theft, slavery, and murder while lending salience to the most reactionary elements in West German political discourse.

Abstract

This book provides the student, researcher or practitioner with the tools to understand many of the most commonly used advanced statistical analysis tools in criminology and criminal justice, and also to apply them to research problems. The volume is structured around two main topics, giving the user flexibility to find what they need quickly. The first is "the general linear model" which is the main analytic approach used to understand what influences outcomes in crime and justice. It presents a series of approaches from OLS multivariate regression, through logistic regression and multi-nomial regression, hierarchical regression, to count regression. The volume also examines alternative methods for estimating unbiased outcomes that are becoming more common in criminology and criminal justice, including analyses of randomized experiments and propensity score matching. It also examines the problem of statistical power, and how it can be used to better design studies. Finally, it discusses meta analysis, which is used to summarize studies; and geographic statistical analysis, which allows us to take into account the ways in which geographies may influence our statistical conclusions.
