Abstract

Wie muss der Staat Opferschutz im Migrationsrecht gestalten? Um rechtsdogmatische Fragestellungen zum Aufenthaltsrecht Betroffener von Hasskriminalität zu beantworten, bedient sich die vorliegende Untersuchung auch sozialwissenschaftlicher und viktimologischer Erkenntnisse. Der hybriden Rechtsmaterie wird durch die Analyse europa- und völkerrechtlicher Vorgaben sowie des deutschen Verfassungs-, Verwaltungs- und Straf(verfahrens)rechts Rechnung getragen. Darüber hinaus wird die Verwaltungspraxis in der Bundesrepublik empirisch untersucht. Deutlich wird der Bedarf einer Reform zur Klarstellung der aufenthaltsrechtlichen Position für Betroffene von Hasskriminalität. Die Arbeit schließt mit entsprechenden Gesetzesvorschlägen.

We go to war and are prejudiced against our fellow human beings. We discriminate on the basis of nationality, class, race, sexual orientation, religion, and gender. Why are humans at once so social and so hateful to each other? In this book, prominent philosopher Michael Ruse looks at scientific understandings of human hatred, particularly Darwinian evolutionary theory. Abstract

"Enmity between individuals was an ubiquitious phenomenon in the ancient world. Using the method of legal anthropology this book examines patterns of hate-driven feuding in kinship-based and segmentary societies and applies these insights to biblical law. It defines the fundamental categories of enmity, love, revenge, honor and shame in the context of feuding and it illustrates certain legal actions, such giving false witness, and shows how they are expressions of hateful relationships. Adam proposes that we should understand hate between individuals as a legal construct that becomes visible when lived out as private enmity, a social status that exhibits distinct hallmarks. In kinship-based societies, private hate/enmity was publicly declared and, consequently, was publicly known in one's own kin and beyond. Private enmity was acted out in feud-like patterns, with a flexibility that allowed opponents to choose between various measures to hurt their opponent. Acting out hate was reciprocal, and it typically escalated and swiftly expanded into one party's attempt to kill the other and to trigger a blood feud. Finally, private enmity was "transitive" in the sense that opponents at enmity naturally expected solidarity from kin and friends. Adam uses textual analysis to illustrate how the legal construct of hate informs biblical law from the Covenant Code, to Deuteronomic and Priestly Legislation, including the Holiness Code. He also demonstrates how hate forms the backdrop of conflict settlement. Ultimately, by ways of tracing back through the category of private hate and enmity, this book unpacks the meaning of the quintessential command to 'Love your neighbor!'"

Hate speech continues to be an issue of key social significance, yet while its lexical and discursive aspects have been widely studied, its grammatical traits have been hitherto overlooked. This book seeks to address this gap by bringing together a global team of scholars to explore the morphosyntactic features of hateful and aggressive discourse. Drawing on thirteen diverse cross-linguistic case studies, it reveals how hate is expressed in political discourse, slang, and social media, and towards a range of target groups relating to gender, sexual orientation, and ethnic identity. Based on ideas from functional and cognitive linguistics, each thematic part demonstrates how features such as morphology, word formation, pronoun use, and syntactic structures are manipulated for the purpose of expressing hostility and hate. Die Frühe Neuzeit ist bekannt dafür, dass sich die Kontrahenten in konfessionellen Streitfragen gegenseitig heftig attackierten. Ein herausragender Vertreter dieser Form der Auseinandersetzung war Martin Luther. In den zahlreichen von ihm verfassten Streitschriften zeigt er sich auch als großer Polemiker. Wie diese Art der sprachlich aggressiven Argumentation funktioniert, wird in der vorliegenden Studie detailliert vorgeführt. Gegenstand der Untersuchung ist die wohl prominenteste Streitschrift Luthers von 1545 "Wider das Papsttum zu Rom vom Teufel gestiftet". Auf der Basis der "neuen Rhetorik" mit ihrer deutlich weiter gefassten Definition dessen, was unter Argumenten und Argumentation verstanden werden kann, konnten mehr als 60 verschiedene Argumentationsformen eruiert werden, die verschiedene Argumentationsfunktionen erfüllen. Die Studie möchte damit sowohl einen Beitrag zur Argumentationsanalyse und einen Vorschlag zur Modellierung von Argumentationen anbieten als auch eine praktische Detailanalyse sprachlicher Aggression, die nachvollziehbar macht, worin genau der in der Forschung häufig adressierte Grobianismus dieser Texte liegt.
