Abstract

This book analyzes United Nations (UN) interventions in the process of constitution making in states undergoing political change. It combines theoretical considerations of democracy and constitutionalism with empirical experiences and takes a critical perspective on the interventions developed by the United Nations in the processes of re-democratization. Presenting new empirical evidence on the substantive and procedural way in which the UN undertakes constitution building in Cambodia, Bosnia and Herzegovina, Afghanistan, and East Timor, the book illustrates difficulties of these practices such as the promotion of popular participation, as well as an increasing Westernization, and to meet local needs. In consequence, the authors call for reforms of the actions and structural methods the UN to better align a legitimate constitutional order with the rule of law and democratic values. This book is aimed at scholars and students of politics and law who are interested in the prerequisites and conditions for further democratization in states undergoing political transformation.

Abstract

This book discusses whether democracy and republicanism are identical, complementary, or contradicting ideas. The rediscovery of classic republicanism a few decades ago made it clear how profoundly modern notions of democracy had been shaped by the republican tradition. But defining these two concepts remains difficult, and the views diverge widely. The overarching aim of this book is to discuss the extent to which democracy and republicanism are identical, complementary or mutually contradicting ideals / ideas. Abstract

This book aims to explore the construction of Chinese law, with an evolution that has been strongly inspired by international law that has functioned as a "pioneer of legal civilization" in China. Chinese law is a fluid sedimentation of traditional elements of Chinese culture and the internalization of external elements. The internal dimension of Chinese legal evolution therefore coincides with a progressive incursion also at the international level, questioning the traditional rules of international relations. The most relevant and comprehensive concept that has been proposed by China in recent years is certainly the idea of building a "community of shared future for mankind." Abstract

This research monograph examines presidential constitutional conventions and the role they play in the political systems of four Central European countries - the Czech Republic, Slovakia, Hungary, and Poland. As primarily unwritten rules of constitutional practice, constitutional conventions represent political arrangements and as such are political in origin. Not only this, constitutional conventions, in general, and presidential constitutional conventions, in particular, have significant political implications. They shape both the everyday operation and character of regimes. Central Europe represents a particularly useful example on which this role of constitutional conventions can be studied and assessed.
