Abstract

La consommation de l'infraction est une expression très familière à la communauté des juristes, notamment ceux qui s'intéressent aux sciences criminelles. Pourtant, le législateur n'a jamais pris la peine de la définir. Que recouvre exactement cette notion ? Quelle est son utilité ? A priori, la consommation de l'infraction s'oppose à la tentative pour désigner la constitution pleine et entière de l'infraction. Elle ne serait donc pas autre chose que la réunion des éléments constitutifs de l'infraction. Cette opposition séculière entre consommation et tentative n'est pourtant pas absolue, comme l'illustre un arrêt récent de la Cour de cassation où elle affirme qu'une tentative est consommée. La première pourrait donc être l'objet de la seconde. Cette nouvelle lecture de la consommation incite à la réflexion tant cette notion s'avère beaucoup plus incertaine qu'il n'y paraît. Évoquée dans une unique formule au sein du Code pénal, la consommation semble avoir été délaissée par le législateur au profit d'autres expressions, comme la commission de l'infraction. On peut le regretter car son rôle s'avère tout à fait fondamental. En plus de constituer, en principe, le seuil de déclenchement de la répression pénale et d'emporter l'irréversibilité de l'acte, la consommation influe sur le champ d'application de la complicité punissable ou sur la localisation spatiale et temporelle de l'infraction. Elle est aussi déterminante dans la mise en œuvre du principe non bis in idem et dans celle des règles qui président à la résolution des conflits de lois, à la prescription de l'action publique ou encore à la récidive. Face à tous ces enjeux, un nouvel éclairage substantiel de la notion de consommation s'imposait donc. Si l'exemple des droits étrangers pourrait inviter à voir en elle un simple moment dans la vie de l'infraction (précisément celui où elle devient irréversible), une telle présentation doit être écartée. Parce qu'en exprimant la parfaite correspondance entre les faits accomplis par l'agent et le texte d'incrimination, la consommation apparaît comme le trait d'union entre le fait et le droit ; entre les faits et l'infraction qu'ils constituent. Elle incite à voir dans l'infraction non plus seulement un corps composé des faits incriminées (le corpus delicti), mais également la vie qui l'anime. Mais par la consommation, l'infraction ne fait pas que naître. Elle va également exister. Ce faisant, la consommation lui permet d'atteindre sa perfection, son idéal, sa fin : générer la responsabilité pénale de son auteur

Abstract

"Being serious demands serious kinds of work. In Styles of Seriousness, Steven Connor reflects on the surprisingly various ways in which a sense of the serious is made and maintained, revealing that while seriousness is the most powerful feeling, it is also the most poignantly indeterminate, perhaps because of the impossibility of being completely serious. In colloquy with philosophers such as Aristotle, Nietzsche, James, Sartre, Austin, Agamben and Sloterdijka and writers like Shakespeare, Byron, Auden and Orwell, Connor considers the linguistic and ritual behaviors associated with different modes of seriousness: importance; intention, or ways of really 'meaning things'; sincerity; solemnity; urgency; regret; warning; and ordeal. The central claim of the book is human beings are capable of taking things seriously in a way that nonhuman animals are not, for the unexpected reason that human beings are so much more versatile than most animals at not being completely serious. One always in fact has a choice about whether or not to take seriously something that is supposed to be so. As a consequence, seriousness depends on different kinds of formalization or stylized practice. Styles of seriousness matter, Connor shows, because human beings are incapable of simply and spontaneously existing. Being a human means having to take seriously one's style of being"--

Abstract

In the past decade, numerous military operations by outside states have relied on the real or alleged 'invitation' of one of the parties. In this book, three experts examine the relevant legal issues, from sovereignty to the scope and relevance of consent, the use of force to the role of the Security of Council. Using critical historical analysis, qualitative case studies and large-N empirics, these topics are debated and addressed in a unique trialogue format. Accommodating the pluralism of the field, the trialogical setting highlights the divergences and commonalities of each of the three approaches. Benefiting from an in-depth analysis of recent cases of armed intervention and the diversity of the authors' perspectives, this collection is key to developing a richer understanding of the law of military intervention. Abstract

Il y a quelques années encore, on enseignait que le droit de la personne et de la famille relevait largement de l’ordre public. Cette affirmation doit aujourd’hui être nuancée au regard de l’essor spectaculaire qu’ont connu le droit à l’autodétermination et l’autonomie de la volonté. D’importantes réformes législatives ont été adoptées grâce notamment à l’impulsion motrice donnée par la Cour européenne des droits de l’homme et la Cour constitutionnelle. Il semble dès lors opportun de marquer un temps d’arrêt afin de s’interroger sur les contours actuels de l’autonomie de la volonté en droit de la famille.Alliant réflexions théoriques et pragmatiques, les auteurs ont pris le parti d’examiner de manière très concrète le champ de l’autonomie versus ordre public ou règle impérative, et ce tant sous le prisme du droit interne que du droit international privé. L’occasion leur a ainsi été donnée, entre autres, d’examiner l’incidence du nouveau Code civil sur les conventions matrimoniales et de cohabitation légale et de définir le rôle que peuvent jouer les conventions en matière de filiation. Par ailleurs, les règlements européens adoptés en matière de droit de la famille offrent aux parties de nouvelles opportunités de contourner une interdiction du droit belge en se plaçant volontairement sous l’égide d’un droit étranger plus permissif, ce qui ne manque pas de susciter craintes et convoitises. Enfin, le divorce par consentement mutuel, le testament et les pactes successoraux permettent d’illustrer de manière concrète l’ampleur de l’autonomie de la volonté en matière de divorce et de planification successorale.

Abstract

In Shakespearean Issues, Richard Strier has written a set of linked essays bound by a learned view of how to think about Shakespeare’s plays and also how to write literary criticism on them. The essays vary in their foci—from dealing with passages and key lines to dealing with whole plays, and to dealing with multiple plays in thematic conversation with each other. Strier treats the political, social, and philosophical themes of Shakespeare’s plays through recursive and revisionary close reading, revisiting plays from different angles and often contravening prevailing views.Part I focuses on characters. Moments of bad faith, of unconscious self-revelation, and of semi-conscious self-revelation are analyzed, along with the problem of describing characters psychologically and ethically. In an essay on “Happy Hamlet,” the famous melancholy of the prince is questioned, as is the villainy of Rosencrantz and Guildenstern, while another essay asks the reader to reconsider moral judgments and negative assessments of characters who may be flawed but do not seem obviously wicked, such as Edgar and Gloucester in King Lear.Part II moves to systems, arguing that Henry IV, Measure for Measure, and The Merchant of Venice raise doubts about fundamental features of legal systems, such as impartiality, punishments, and respect for contracts. Strier reveals King Lear’s radicalism, analyzing its concentration on poverty and its insistence on the existence and legitimacy of a material substratum to human life. Essays on The Tempest offer original takes on the play’s presentation of coercive power, of civilization and its discontents, and of humanist ideals. Part III turns to religious and epistemological beliefs, with Strier challenging prevailing views of Shakespeare’s relation to both.A culminating reading sees The Winter’s Tale as ultimately affirming the mind’s capacities, and as finding a place for something like religion within the world. Anyone interested in Shakespeare’s plays will find Shakespearean Issues bracing and thought-provoking.

Abstract

Natural interaction is one of the hottest research issues in human-computer interaction. At present, there is an urgent need for intelligent devices (service robots, virtual humans, etc.) to be able to understand intentions in an interactive dialogue. Focusing on human-computer understanding based on deep learning methods, the book systematically introduces readers to intention recognition, unknown intention detection, and new intention discovery in human-computer dialogue.
