"Wat valt er onder het begrip ‘religie’? Wanneer is een uiting ‘haatzaaien’? Wordt het verspreiden van ‘nepnieuws’ beschermd door de vrijheid van meningsuiting? Omvat het recht op leven ook het recht op maatregelen tegen klimaatverandering? Steeds vaker doen mensen een beroep op fundamentele rechten om uiteenlopende aanspraken te onderbouwen. Voorbeelden zijn de claims tegen de Staat in de klimaatzaken, de pleidooien voor erkenning van het recht op een eigen identiteit en het beroep op het recht op lichamelijke integriteit door tegenstanders van verplichte vaccinaties. Hoe ver mag de rechter gaan in het bepalen van de reikwijdte van fundamentele rechten? Zou de rechter alle wetgeving aan de Grondwet moeten kunnen toetsen? Hoe vermijdt hij dat hij daarbij het terrein van de politiek betreedt? Gaat de rechter in sommige gevallen te ver, of juist nog niet ver genoeg? Abstract

Le récit du mouvement pour les droits civiques aux États-Unis a longtemps été écrit au travers des figures de ses leaders. Ce livre propose au contraire d’aborder cette histoire par en bas, en donnant la parole à ses activistes afin de mettre au jour les tensions qui traversaient le mouvement noir dans les décennies d’après-guerre. Les besoins de la lutte tendaient à minorer les clivages de classe et de genre ainsi que les tensions générationnelles. Le maccarthysme a marginalisé la gauche noire et a relégué les femmes à l’arrière-plan, les effaçant du récit historique. Ainsi par exemple, Rosa Parks a souvent été réduite à son seul refus de céder sa place dans un bus ségrégué en 1955, alors qu’elle fut une militante active sa vie durant. À partir d’une étude de récits de militants et militantes et d’archives photographiques, ce livre propose une histoire des actrices et des acteurs oubliés des mouvements de libération noire, les femmes et les militants de gauche. Il replace les luttes des années 1950-1960 dans la longue durée des années 1930 à la période du Black Power des années 1970 et apporte un éclairage nouveau sur une période encore peu abordée en France. Avec le soutien du laboratoire CREW de l’université Sorbonne Nouvelle, de l’université Paris 8 et de l’Institut d’histoire du temps présent (CNRS et université Paris 8).

Erotic Resistance celebrates the erotic performance cultures that have shaped San Francisco. It preserves the memory of the city's bohemian past and its essential role in the development of American adult entertainment by highlighting the contributions of women of color, queer women, and trans women who were instrumental in the city's labor history, as well as its LGBT and sex workers' rights movements. In the 1960s, topless entertainment became legal in the city for the first time in the US, though cross-dressing continued to be criminalized. In the 1990s, stripper-artist-activists led the first successful class action lawsuits and efforts to unionize. Gigi Otálvaro-Hormillosa uses visual and performance analysis, historiography, and ethnographic research, including participant observation as both performer and spectator and interviews with legendary burlesquers and strippers, to share this remarkable story.

Abstract

In this book, Aileen Kavanagh offers a fresh account of how we should protect rights in a democracy. Departing from leading theoretical accounts which present the courts and legislature as rivals for constitutional supremacy, Kavanagh argues that protecting rights is a collaborative enterprise between all three branches of government - the Executive, the legislature, and the courts. On a collaborative vision of constitutionalism, protecting rights is neither the solitary task of a Herculean super-judge, nor the dignified pronouncements of an enlightened legislature. Instead, it is a complex, dynamic, and collaborative endeavour, where each branch has a distinct but complementary role to play, whilst engaging with each other in a spirit of comity and mutual respect. Abstract

Susi offers a novel non-coherence theory of digital human rights to explain the change in meaning and scope of human rights rules, principles, ideas and concepts, and the interrelationships and related actors, when moving from the physical domain into the online domain. The transposition into the digital reality can alter the meaning of well-established offline human rights to a wider or narrower extent, impacting core concepts such as transparency, legal certainty and foreseeability. Susi analyses the 'loss in transposition' of some core features of the rights to privacy and freedom of expression. The non-coherence theory is used to explore key human rights theoretical concepts, such as the network society approach, the capabilities approach, transversality, and self-normativity, and it is also applied to e-state and artificial intelligence, challenging the idea of the sameness of rights. In her lifetime, African American composer Margaret Bonds was classical music's most intrepid social-justice activist. Furthermore, her Montgomery Variations (1964) and setting of W.E.B. Du Bois's iconic Civil Rights Credo (1965-67) were the musical summits of her activism. These works fell into obscurity after Bonds's death, but were recovered and published in 2020. Since widely performed, they are finally gaining a recognition long denied. This incisive book situates The Montgomery Variations and Credo in their political and biographical contexts, providing an interdisciplinary exploration that brings notables including Harry Burleigh, W.E.B. and Shirley Graham Du Bois, Martin Luther King, Jr., Abbie Mitchell, Ned Rorem, and - especially - Langston Hughes into the works' collective ambit.
