Abstract

Patients travelling abroad to receive medical treatment, healthcare providers wishing to establish their seat or to provide services abroad, and students travelling abroad for education were faced with different barriers which have been declared illegal by the Court of Justice of the European Union. Member States started to use market mechanisms in their welfare systems and this triggered the application of the European internal market and competition rules. Fears related to whether all these would endanger the well-functioning of the welfare services have been raised by Member States. Several conflicts took shape: between national social interests and European Union economic interests; between individual interests and national general interests; between regulation and deregulation, centralization and decentralization. The author shows that behind those fears actually protectionist measures are hidden and that the European Law provides sufficient safeguards for the national welfare systems. Abstract

The position and treatment of asylum seekers has been at the centre of attention in most of the Member States of the EU in recent years. These Member States have decided to cooperate more and more on asylum issues. However, this leads to questions concerning the human rights protection of asylum seekers as a result of EU decisions, both at the moment they apply for asylum at the border and during the application procedure. By bringing the opinions of scholars, policy makers and non-governmental organizations together, this book tries to evaluate the consequences and possibilities. The so-called ˜asylum package' of EU asylum legislation and the coming into force of the Treaty of Lisbon means that EU asylum law will become increasingly important for national asylum decisions.   This book is the updated result of a conference on the future of the European asylum policy at Erasmus School of Law in Rotterdam, the Netherlands. After a challenge set by the Dutch State Secretary for Justice, Ms. Nebahat Albayrak, the contributions to this book focus on human rights aspects of the European asylum policy and the way the EU Member States need to cooperate in the future in order to reach results. The authors are scholars, policy makers and representatives of NGOs. Abstract

Is the procedural autonomy of EU Member State a myth or a reality? What should this concept be taken to mean? Starting from the analysis of requirements and principles regulating, generally speaking, the relationships between Member States’ and EU law, this book provides a definition of procedural autonomy able to account for the concept’s inherent limits. Out of an analysis of the more relevant EU jurisprudence, the author identifies the rationale underlying the interventions of the ECJ on issues of procedural autonomy and the common logic that emerges from it; and reveals how, in an unchanged context of ‘procedural autonomy’ of the Member States, national procedural law becomes more and more ‘functionalized’ to the requirements of effectiveness of substantive EU law. As such, we should speak of a ‘functionalized procedural competence’ rather than of procedural autonomy. But this is by no means a case of “Paradise Lost.” The book includes a foreword by Prof. Jürgen Schwarze, one of the founding fathers of European Administrative Law.
