"Conflict Resolution - Actors, Dynamics and Cases deals with multiple concepts and themes of the broad subject area of conflict resolution, seeking to highlight empirical studies that examine several topics from conflict prevention to peacebuilding, including conflict management, institution building, the role of formal and informal actors, the features of conflicts in different political contexts and the methods and strategies used for resolution or transformation (mediation, non-violence, reconciliation, transitional justice, second track diplomacy, peace education, post-conflict reconstruction, among others) in intra- and inter-state conflicts. The book is open to several methodological approaches, focusing on empirical studies that address several cases, including studies on Cyprus, the South Caucasus region, DR Congo, the Middle East region, Tunisia and Iraq, as well as on the role of regional organizations such as the European Union in peace-making and peacebuilding. This unique volume looks at international peace treaties, at their results, effects and failures. It reflects the outcome of an international conference held in the Peace Palace (The Hague) on the occasion of the Centenary of this institution, which opened its doors on the eve of World War I. The volume offers the reflections of the leading experts attending the conference and the open debate which followed. The Treaty of Versailles of 1919, the mother of all peace treaties, is the first to be critically discussed. How should this treaty be viewed with the knowledge of today? What are the lessons learned in the light of historic developments? Subsequently, the Dayton Agreement, which sealed the end to the bloody conflict in the former Yugoslavia (1992-1995), and the Sudan Agreement, which came into being after lengthy negotiations in 2005, are analysed in the same way. Finally, the situations which arose in relation to the devastating wars between Iran and Iraq (1980-1988) and between Kuwait and Iraq are discussed. As these states could not reach a settlement themselves, the United Nations Security Council imposed the terms of the ceasefire and peaceful cooperation in important and innovative resolutions. The book offers additional perspective by looking at the role of judicial settlement by the International Court of Justice or the Permanent Court of Arbitration, vis-a-vis the instrument of political mediation between states with the help of a third party. Mediation can be very effective, but certain conditions are required for it to be successful, conditions which are not easy to bring about in today’s world. Dispute settlement under international law is and continues to be the core business in the Peace Palace.

Abstract

This book examines the use of third-party mediation as a conflict resolution method. In an attempt to explain why some, but not all, conflicts are mediated, this work argues that diverse conflict structures are inherently different in their susceptibility to mediation attempts. By offering a systematic method for measuring the transformability of conflict structures, this book contributes to our understanding of the sufficient and necessary conditions for mediation. In addition, the study offers an analytical framework for the examination of mediation as a trilateral rational bargaining process. Although the general concept of mediation as a three-person game is not new, most studies focus on either the disputants' perspectives or the mediator's perspective. In contrast, this study integrates the perspectives of all three parties. The framework links the different stages involved in the whole process of mediation, from the onset of mediation, through the mediation strategies used, to the outcome, rather than focusing on one particular aspect. The book applies the framework to two case studies - the conflict between Israel and Egypt and the conflict between India and Pakistan - and provides new insights into these conflicts from a mediation perspective. In general, the model developed here provides a framework for systematically assessing conflicts and the options available to those involved in the mediation process.
