This collection of essays looks at the role the European Union could and should play in promoting healthier lifestyle, in light of the moral, philosophical, legal and political challenges associated with the regulation of individual choices. By tackling the main non-communicable diseases (NCD) risk factors (tobacco consumption, harmful use of alcohol, unhealthy diets and lack of physical activity), the contributors endeavour to identify common themes and determine whether and, if so, to what extent the lessons learned in relation to each area of EU intervention could be transposed to the others. By focusing on the European Union legal order, the book highlights both the opportunities that legal instruments offer for NCD prevention and control agenda in Europe, as well as the constraints that the law imposes on policy-makers.

Depuis le droit romain, le corps humain n’est pas traité comme une chose.C’est l’artifice d’une fiction juridique qui englobe le corps dans la personne. De nos jours, cette belle harmonie entre la personne et son corps se voit lézardée par les progrès biotechnologiques. Désormais, le corps peut se muer en objet scientifique, ses parties sont susceptibles d’être intégrées dans le corps d’une autre personne et les éléments humains se transformer en simple matériel biologique.Nous vivons une ère nouvelle, celle où le corps humain est devenu un enjeu social, celle où la protection de celui-ci par la seule volonté individuelle est devenue insuffisante. C’est l’humanité de ce corps qui, d’ores et déjà, fait problème et qu’il convient de sauvegarder.La parution de cet ouvrage se propose de combler un vide philosophico-juridique. Son enjeu est de répondre aux interrogations fondamentales suivantes : Comment et dans quelle mesure le droit protège-t-il ce corps humain mis à distance de la personne et pour ainsi dire mis à nu ? Quelles obligations la personne a-t-elle envers son corps ? Quels principes juridiques les systèmes de droit de vingt pays analysés posent-ils pour protéger le corps humain ? The book’s main contribution is its interdisciplinary approach to the issue of sedation at the end-of-life. Because it occurs at the end of life, palliative sedation raises a number of important ethical and legal questions, including whether it is a covert form of euthanasia and for what purposes it may legally be used. Many of the book chapters address the first question and almost all deal with a specific form of the second: whether palliative sedation should be used for those experiencing “existential suffering”? This raises the question of what existential suffering is, a topic that is also discussed in the book.
