David Boonin has written the most thorough and detailed case for the moral permissibility of abortion yet published. Critically examining a wide range of arguments that attempt to prove that every human fetus has a right to life, he shows that each of these arguments fails on its own terms. He then explains how even if the fetus does have a right to life, abortion can still be shown to be morally permissible on the critique of abortion's own terms. Finally he considers several pro-life arguments that do not depend on claims that the fetus has a right to life and concludes that these too are ultimately unsuccessful. This major book will be especially helpful to those teaching applied ethics and bioethics in philosophy departments or professional schools of law and medicine. Pratique universellement répandue, l'avortement est légalisé en France, à l'instar de la majorité des pays occidentaux. Introduit de ce fait dans l'espace public, il demeure néanmoins confiné dans l'espace de l'officieux, par suite d'une sorte de pacte tacite, de mauvaise foi sociale. S'appuyant sur une centaine d'observations recueillies à l'hôpital et quarante entretiens approfondis avec des femmes ayant connu l'expérience de l'avortement, sur des données empruntées à l'histoire et à l'anthropologie, Luc Boltanski explique ce refoulement. L'avortement doit rester dans l'ombre car il révèle une contradiction au foyer du contrat social celle qui oppose le principe de l'unicité des êtres et le postulat de leur nature remplaçable, sans lequel nulle société ne se renouvellerait démographiquement. Luc Boltanski est alors conduit à poser la question de l'engendrement et analyser les contraintes essentiellement symboliques qui président à l'entrée des êtres humains dans la société. Des contraintes antinomiques que différents types d'arrangements sociaux tendent à estomper. Ce qui fait un être humain, ce n'est pas le fœtus, inscrit dans le corps, mais son adoption symbolique. Or, cette adoption suppose la possibilité d'une discrimination entre des embryons que rien ne distingue. Le caractère arbitraire de cette discrimination est au plan social, et parfois individuel, difficilement supportable. La contradiction, montre Luc Boltanski, est rendue vivable par une sorte de grammaire des catégories : au fœtus projet - adopté par les parents qui, grâce à la parole, accueillent l'être nouveau en lui donnant un nom - s'oppose le fœtus tumoral, embryon accidentel et qui ne sera pas l'objet d'un projet de vie. Grammaire, expérience mise en récit et perspective historique se nouent ici pour faire de l'avortement, rendu depuis des décennies politiquement légal, une expérience désormais socialement audible.

A contribution to the abortion debate. Tracie Martin understands personhood in terms of psychological states and argues that early foetuses who lack the relevant mental states are not persons. However, she feels that by 24 weeks gestation foetuses have acquired the relevant characteristics. Ever since Michael Tooley published his article on "Abortion and Infanticide" in 1972, the abortion debate has revolved around questions such as: "What is a person?"; "What is it that gives persons the right to life?"; and "Is it wrong to kill potential persons?" This study defends a position that accepts elements from both the liberal and conservative tradition. Following Tooley, Tracie Martin understands personhood in terms of psychological states and agrees that early foetuses who lack the relevant mental states are not persons. While this might seem a victory for the liberal tradition, Martin then goes on to provide an empirically-based argument for the view that by 24-weeks gestation foetuses have acquired the relevant characteristics that provide strong grounds for thinking that it is directly wrong to kill such foetuses.

Ectogenesis, the gestation of the foetus outside of the human body, will not for much longer be in the realm of science fiction; a number of projects attempting to develop ectogenetic technology are currently under way. This book examines the ethical implications of the development of ectogenesis. Examining the implications for abortion ethics in particular, this book also deals with the ethical objections to developing such a technology and the uses to which it may be put, such as creating embryos to supply donor organs for transplantation. The development of the artificial uterus may well be similar to cloning: a sudden technological advance with dramatic ethical implications, thrust suddenly into the public eye.
