In the last decade health care has witnessed a host of technological novelties in the field of diagnostic and therapeutic practices, as well as in the supportive information and communication technology and in various applications of genetics, microbiology and informatics. As a result a few questions need to be answered: -Is health care ethics due dor a splitting up into an ethics of technology (focusing on the ethical implications of new technologies) and an ethics of care (focusing on the ethical problems concerning chronic diseases, decay, disability, end of life)? -How to cope with dependence, limitation, finiteness, suffering, ... in spite of technological progress? -Could a better integration of technology and care preclude situations where patients are being dehumanised? Starting with a philosophical ethical reflection about the possibilities and dangers of technologies in health care, this book highlights both the relation between technology and care, and the normative aspects of economic analyses in health care. Finally, a series of concrete examples from various clinical fields (prenatal diagnosis, genetic tests, digital imaging in psychiatry, tube feeding in care for the elderly, and palliative sedation) will help the authors to consider how to integrate these technologies in a care context aimed upon humaneness. Since each topic is analysed by leading European clinicians and health care ethicists, this book clearly stands for the interdisciplinary approach in health care ethics. This book may be a rich source of material for reflection on the role, meaning and ends of technology and care, as harmonious aspects of clinical health care practice. However, the authors main concern is to show what such a reflection may consist of and how it can contribute to the inquiry into the experience of technology, the needs of humanity and the development of appropriate health care. Pourquoi rassembler soins curatifs et soins palliatifs dans un même ouvrage? Parce qu'il n'y a pas d'endroits, pas de services hospitaliers, pas de disciplines médicales où les artisans de la médecine puissent se permettre de négliger la dimension humaine de leur métier, de leurs travaux, de leurs recherches. C'est d'ailleurs à partir des préoccupations scientifiques et techniques volontairement ou involontairement séparées des préoccupations de soins et d'accompagnement que la médecine s'est déshumanisée jusqu'à ne plus connaître et nommer le malade que sous l'angle de sa pathologie. C'est sur ce terrain miné de la déshumanisation de la médecine que, comme l'on sait, les soins palliatifs se sont mobilisés en faveur de l'écoute et de l'accompagnement des grands malades en fin de vie. Mais ceci étant, la tentation existe pour la médecine curative d'enkyster la mort dans des lieux spécifiques, ce qui la dispense d'avoir à se soucier d'un accompagnement qu'elle juge ou qu'elle croit n'être réservé qu'à des malades en fin de vie. Il en résulte une dichotomie entre médecine curative et médecine palliative dont les patients, et jusqu'aux familles, font les frais. Non qu'ils se plaignent d'être mal soignés, mais bien d'être peu accueillis, mal écoutés, pas compris en tant que personnes à part entière. La poursuite des progrès en médecine dont personne ne conteste la nécessité, dont tout le monde salue les extraordinaires développements, doit aujourd'hui avoir pour contrepartie indispensable l'accompagnement humain et spirituel des malades et des mourants, quel que soit le service où il est pris soin des uns et des autres.

L'éthique a-t-elle quelque chose à voir avec la spiritualité, et réciproquement ? Témoin et accompagnateur d'équipes soignantes et de groupes d'éthique clinique, l'auteur est convaincu que les acteurs du soin engagent bien plus que leur seule rationalité dans les processus de décision éthique. Il y va également de leurs convictions les plus intimes. En ce sens, la spiritualité ne devrait-elle pas être pensée comme un " en-deçà " de l'éthique ? Les soins palliatifs ne sont-ils pas le lieu privilégié où se nouent l'éthique et la spiritualité, tant pour les professionnels de la santé que pour les patients ? Face au destin personnel du malade en sa globalité, chacun est invité à s'interroger sur le sens ultime de cette souffrance. Articulant les approches éthique et spirituelle pour que toutes deux puissent être rencontrées dans le soin, l'ouvrage vise surtout à rendre crédible le terme même de spiritualité. Celui-ci est de plus en plus présent dans la littérature soignante, sans toutefois être précisé, si ce n'est en termes de nécessité, d'obligation ; ce qui n'aide ni à penser, ni à accompagner...

De invoering van de Wet Patiëntenrechten, de Euthanasiewet en de Wet Palliatieve Zorg (2002) heeft geleid tot een explosie van richtlijnen, procedures en protocollen in Belgische zorginstellingen. Een dergelijk beleid vormt vaak ook een weerspiegeling van de ethische instellingsvisie rond levenseindezorg. In dit boek wordt de rechtspositie van de beheerder, het artsenkorps, de patiënten en de overheid hierbij onderzocht. Heel wat gevoelige themas komen aan bod, zoals kan een instelling euthanasie verbieden?, zijn patiënten verplicht om niet wettelijk voorziene procedures te ondergaan? en kan de overheid instellingen die de wet niet toepassen, sanctioneren?. Daarnaast wordt een reeks voorstellen geformuleerd om de toegang van patiënten tot euthanasie beter te beschermen.In dit boek wordt het ethische instellingsbeleid voor het eerst op uitgebreide wijze juridisch geanalyseerd.
