"The life-history record is a relatively new instrument for the study of human behavior. As such it should be used with full consciousness of its values, limitations, and possible shortcomings. No one will question the value of the life-history as a human document when written freely and frankly. It admits the reader into the inner experience of other men, men apparently widely different from himself: criminals, hobos, and other adventurers. Through the life-history he becomes acquainted with those far removed from the sheltered routine of his own existence in much the same intimate way that he knows himself or a friend. As he lives, for the time being, their careers and participates in their memories and mistakes, aspirations and failures he comes to realize the basic likeness of all human beings despite the differences, real as they are, of biological endowment and social experience.

L'entità e la frequenza delle riforme penali degli ultimi due decenni hanno portato alla ribalta del dibattito penalistico il tema della persistenza della funzione incriminatrice della fattispecie penale oggetto di modifica. Se e come un soggetto, che ha commesso un fatto di reato sotto la vigenza di una fattispecie poi riformulata, possa essere punito ai sensi della norma successiva è questione che ha impegnato dottrina e giurisprudenza in un serrato confronto volto a individuare le condizioni della continua punibilità. L'autore ricostruisce il tema dell'"inerzia" della funzione incriminatrice della fattispecie percorrendo i sentieri italiani e tedeschi del dibattito. Facendo riferimento alle teorie gradualistiche del reato e alla forma tipologica della fattispecie penale, approfondisce i rapporti tra fattispecie astratta e fatto storico, rapporti che disegnano lo scenario dentro il quale egli muove il tentativo di un fondamento epistemologico del concetto di sottofattispecie penale.

"Man's desire for freedom must be taken as a byproduct of his instinct for self-preservation, for certainly there is no more compelling force to be encountered. To get out of prison, the prisoner will endure everything, dare anything. There seems to be no limit to his capacity. It is observable also that there is, apparently, a breaking point in the lives of most men who are immured. When this point is reached the prisoner either gives up hope or tries to escape. The time cannot be charted. I have known men to break prison within six months of the end of their term. This book fills a very real gap in the literature on the subject. There is a small library on escapes and the escaper, but it deals in large part with the noncriminal. Here we have the convict of today, the men with whom our prisons are filled at this moment. To this study the author brought both expert knowledge and a deal of human understanding. He was wise enough to know the value of the modern scientific point of view on the criminal, and to this point of view he himself made notable contributions.
