This book contains contributions that form the basis of the presentations held at the Fourth Joint CEPANI NAI Colloquium, which took place in Rotterdam on 22 April 2022. The various contributions focus on topical arbitration trends of 2022. The trends are looked at both from the perspective of the New CEPANI Arbitration Rules (2020) and from the perspective of the New NAI Arbitration Rules (2022). Specific topics discussed are, inter alia, e-Arbitration, early determination, confidentiality & transparency, data protection, cybersecurity, third party funding, and expedited arbitration. Some topics were consciously not included in the new arbitration rules. Proper solutions may yet be reached on the basis of the general provisions in these rules. More fundamental trends, such as diversity & inclusion in arbitration and greener arbitrations, are discussed in separate chapters. The book aims to provide guidance for a balanced approach of the trends signaled.

Au-delà d'être à la source du développement législatif de l'arbitrage, le CEPANI est, avant tout, une institution qui a su s'imposer comme le centre d'arbitrage de référence en Belgique et comme un centre reconnu et apprécié à l'étranger, ce qui lui vaut, notamment, d’administrer chaque année un nombre considérable d’arbitrages internationaux et d'avoir acquis aux côtés d'autres grands centres d'arbitrages étrangers, la qualité d'observateur au sein du groupe de travail II de la CNUDCI « Arbitrage et Conciliation / Règlement des différends ». Dans ce cadre la CEPANI a adopté, très rapidement après sa constitution, un règlement d'arbitrage qui a évolué au fil du temps pour devenir à ce jour un règlement adapté aux défis actuels des procédures arbitrales. Les autres modes alternatifs ne sont pas en reste. L'activité scientifique du CEPANI doit également être mentionnée. Il est essentiel de marquer cette étape que constitue l’anniversaire des 50 ans du CEPANI.Qu’est-ce qui rend la publication unique ?
