Katrien Lefever New Media and Sport International Legal Aspects With a Foreword by Prof. Dr. Stefaan Van den Bogaert, Professor of European Law, University of Leiden, The Netherlands During the past decade, the media landscape and the coverage of sports events have changed fundamentally. Sports fans can consume the sports content of their choice, on the platform they prefer and at the time they want. Furthermore, thanks to electronic devices and Internet, content can now be created and distributed by every sports fan. As a result, it is argued that media regulation which traditionally contains rules safeguarding access to information and diversity would become redundant. Moreover, it is sometimes proposed to leave the regulation of the broadcasting market solely to competition law. This book illustrates that media law is still needed, even in an era of abundance, to guarantee public’s access to live and full sports coverage. Dealing with the impact of new media on both media and competition law this book will greatly appeal to academics and stakeholders from various disciplines, such as legal and public policy, political science, media and communications studies, journalism and European studies. Additionally it contains valuable information and points of view for policy makers, lawyers and international and intergovernmental organisations, active in media development. The book contains an up-to-date analysis and overview of the different competition authorities’ decisions and media provisions dealing with the sale, acquisition and exploitation of sports broadcasting rights. Katrien Lefever is working as a legal councel at the Vlaamse Media Maatschappij (VMMa). She prepared this book while working as a legal researcher at IBBT - The Interdisciplinary Centre for Law and ICT (ICRI), KU Leuven, Belgium. The book appears in the ASSER International Sports Law Series, under the editorship of Prof. Dr. Robert Siekmann, Dr. Janwillem Soek and Marco van der Harst LL.M.

Door de opkomst van digitale televisie en internet is "de kijker" een actieve consument geworden die zelf beslist waar, wanneer en hoe hij naar audiovisuele content kijkt. Bovendien heeft de digitalisering geleid tot een nooit geziene drempelverlaging voor de productie van audiovisuele media ... en dus ook tot een vertroebeling van het traditionele onderscheid tussen producent en consument. Deze evoluties hebben het traditionele mediarecht danig onder druk gezet. Ook in Vlaanderen: het Vlaamse Mediadecreet werd grondig herzien. Dit dossier bespreekt het Mediadecreet van 2009 in detail, net zoals de wijzigingen op wetgevend vlak die zich na de inwerkingtreding van dit decreet voltrokken. Daarna volgt een korte beschrijving van de achtergrond van de herziening van het decreet, het toepassingsgebied, het begrippenapparaat, het drielagenmodel en de verplichtingen die van toepassing zijn op de verschillende actoren in de mediasector. Tot slot staan de auteurs stil bij de vraag welke aanbieders van audiovisueel materiaal op internet onder het toepassingsgebied vallen van het Mediadecreet en aan welke verplichtingen zij dan al dan niet moeten voldoen.

Deze masterscriptie beschrijft een onderwerp dat een interactie vormt tussen sport, het mediarecht en het mededingingsrecht. Het gaat om de territorialiteit van content versus cross-border portability of grensoverschrijdende overdacht of toegang tot content, waarbij de focus ligt bij grote sportevenementen. Het valt niet te onderschatten hoeveel sociaal en economisch belang sport en het verspreiden en kijken van sportcontent hebben. Als het publiek geen toegang heeft tot deze sportevenementen en uitzendingen ervan, is hun recht op informatie in grote mate beperkt. Momenteel geldt in de landen van de Europese Unie een systeem van territoriale verspreiding en toegang tot content, waardoor de programma's, evenementen of informatie niet vrij kunnen worden uitgezonden in andere landen. Dit is om wille van grote verschillen qua taal en culturele voorkeuren in de verschillende lidstaten. Maar als personen gaan wonen, werken of studeren in het buitenland, zullen ze misschien wel graag van daaruit naar de Belgische wedstrijden willen kijken, wat nu niet mogelijk is om contractuele redenen, toch niet zoals zij worden uitgezonden op de Belgische tv.Deze territorialiteit van sportcontent kan dus in vraag worden gesteld, ten eerste volgens het mededingingsrecht. Aan de hand van het belangrijke arrest Karen Murphy wordt nagegaan of het mededingingsrecht een nieuwe regeling vereist. Ook de Europese Commissie is een onderzoek gestart naar grensoverschrijdende toegang tot betaaltelevisiediensten.In deze scriptie wordt nog een stap verder gegaan en wordt de optie van cross-border portability onderzocht. Via een afweging tussen het recht op informatie van het publiek enerzijds en de belangen van sportorganisaties en omroepen anderzijds wordt volgens artikel 10 van het Europees Verdrag ter bescherming van de Rechten van de Mens nagegaan of een inperking van de contractuele vrijheid proportioneel is.
