Procédure fascinante et résolument d'actualité, l'action collective, aussi connue sous le nom de « recours collectif» ou « class action», est considérée par certains comme un «monstre» procédural, ancré dans les mœurs et les pratiques d'un pays de Cocagne.Or, entre l'opulence qui caractérise - du moins de façon anecdotique - l'action collective, et le mythe de la procédure collective qui enrichirait principalement les avocats à défaut d'indemniser les justiciables, il est impératif de remettre les pendules à l'heure. C'est bien ce que ce livre cherchera à faire.Qu'ils soient de portée nationale ou internationale, une cinquantaine de nouveaux dossiers d'action collective sont déposés chaque année auprès des tribunaux québécois. Généralement, plusieurs années s'écouleront avant que ces dossiers se règlent par un jugement au mérite ou par une entente à l'amiable. Pendant ce temps, ces actions auront généré des millions, voire des milliards de dollars en indemnisation et en frais d'avocats. Ce jeu en vaut-il la chandelle? Les justiciables obtiennent-ils une indemnisation significative, proportionnelle aux coûts élevés de la procédure collective?La valeur intrinsèque de la procédure d'action collective a suscité beaucoup de débats au cours des dernières décennies. Deux grands thèmes s'en dégagent: l'accès à la justice pour le citoyen et la compensation efficace et équitable des justiciables dans un contexte d'action collective. Ces objectifs sont-ils atteints?

This book reviews the knowledge corpus about access to civil justice across disciplines and legal traditions and proposes a new research framework for civil justice reform. This framework is intended to foster further critical analysis of the justice system in a systematic and organized way. In particular, the framework underlines the tensions between different values considered as central to the civil justice system, and in doing so potentially allows for conscious, reflected and enlightened choices about the values that are to be prioritized in the reform of justice systems.
