De nachtwinkels zijn wettelijk gedefinieerd in de wet openingsuren van 10 november 2006 en moeten voldoen aan volgende voorwaarden: a) geen andere activiteit uitoefenen dan de verkoop van algemene voedingswaren en huishoudelijke artikelen ; b) de netto verkoopsoppervlakte mag niet groter zijn dan 150 m² en c) op een duidelijke en permanente manier de vermelding "nachtwinkel" dragen. Vermits er voor de nachtwinkels geen aparte NACE-code voorzien is bij inschrijving in de Kruispuntbank van Ondernemingen (KBO) zijn er ook geen cijfers over beschikbaar die afkomstig zijn uit administratieve bronnen (zoals KBO, BTW, RSZ, DBRIS). De Vlaamse Vereniging voor Steden en Gemeenten (VVSG) organiseerde daarom zelf een bevraging naar aantallen alsook naar de specifieke gemeentelijke maatregelen. Net als in 2003 werden de resultaten van de nieuwe bevraging in 2013 verwerkt in een rapport.
