Abstract

In The EU-Ukraine Association Agreement and Deep and Comprehensive Free Trade Area , Guillaume Van der Loo provides the first comprehensive legal analysis of this complex and controversial international agreement. While key political and legal hurdles towards the signing and conclusion of this agreement are analysed, its scope and contents are scrutinised and contrasted to other international agreements concluded by the EU. Specific attention is devoted to the ambitious “deep and comprehensive free trade area” and the unique provisions related to Ukraine’s approximation to the EU acquis. In particular, this book explores to what extent the agreement can be considered a new legal instrument for ‘EU integration without membership’.

Abstract

"While provisions relating to a common commercial policy (CCP) were already to be found in Articles 110- 116 of the original Treaty of Rome, and a common customs tariff was established during the 1960s,1 it was only in an Opinion of 1975 that the European Court of Justice (ECJ) confirmed explicitly that the CCP belongs to the area of the exclusive competence of the Community.2 The Court held that the field of export credits fell under the ccp, observing that a concurrent competence of the Member States would distort competition between undertakings of the various Member States. In subsequent case law, the Court, as far as the trade in goods was concerned, confirmed its fairly broad understanding of the concept of ccp, including various sorts of restrictions or regulations such as technical, sanitary and other barriers to trade and tariff preferences in favour of developing countries"--

Abstract

The EU-US Summit on 15 June 2021 marked the beginning of a renewed transatlantic partnership and set an ambitious joint agenda for EU-US cooperation post-COVID-19. The new Biden administration offers the EU the opportunity to re-establish transatlantic relations, which reached their lowest point since World War II under the turbulent Trump administration, and to address the bilateral disputes and tensions that have emerged, partly as a result of Trump’s‘ America First’ policies. One of the key deliverables of the Summit was the establishment of the EU-US Trade and Technology Council (TTC). The TTC aims to deepen EU-US relations on trade and investment and to avoid new technical barriers to trade by cooperating on key policies such as technology, digital policy issues and supply chains.
