Depuis toujours, la Belgique s’est dotée d’un système spécifique que l’on nomme les allocations d’insertion. Ces allocations sont accordées à des jeunes chômeurs sur la base des études. En principe, les allocations de chômage ordinaires sont octroyées à des travailleurs qui ont cotisé à cette assurance et qui perdent leur travail suite à des circonstances indépendantes de leur volonté. Ces allocations d’insertion constituent donc une exception au système de l’assurance-chômage puisqu’elles sont allouées à des jeunes sans que ceux-ci n’aient jamais cotisé, ni travaillé. Les conditions d’admission permettant d’ouvrir le droit à ces allocations, telles quelles sont prévues par l’article 36 de l’arrêté royal du 25 novembre 1991, ont fait l’objet d’une évolution au fil du temps, tantôt sous l’influence de la jurisprudence européenne, tantôt suite à des modifications réglementaires. En effet, on ne peut cacher que la réglementation belge du chômage est en perpétuel chantier. Que ce soit sous le gouvernement Di Rupo ou sous le gouvernement Michel, celle-ci a toujours été plus ou moins grandement modifiée et les allocations d’insertion n’y ont pas échappé. En 2012, afin de relancer l’emploi des jeunes, plusieurs mesures ont été mises en place par le Gouvernement Di Rupo. Premièrement, ce qu’on appelait auparavant « les allocations d’attente » se sont vues attribuer une nouvelle terminologie. C’est également le cas « du stage d’attente », rebaptisé en stage d’insertion professionnelle. D’ailleurs, à cette occasion, la durée du stage a été généralisée et allongée à 310 jours. Ensuite, c’est le contrôle du comportement actif de la recherche d’un emploi qui a été intensifié, et ses sanctions, elles, alourdies. En 2015, deux autres mesures phares concernant les bénéficiaires des allocations d’insertion ont été introduites : premièrement, la limite d’âge maximale au jour de l’introduction de la demande des allocations a été diminuée de 30 ans à 25 ans. Deuxièmement, les jeunes âgés de moins de 21 ans doivent désormais disposer du diplôme de l’enseignement secondaire ou avoir suivi intégralement une formation en alternance. Au vu de ces éléments, on peut constater que ces modifications vont vers un durcissement des conditions d’accès aux allocations d’insertion. Toutefois, la mesure qui a fait couler le plus d’encre est celle de la limitation des allocations d’insertion à une durée de trois ans, alors qu’elles étaient auparavant illimitées. Cette mesure, entrée en vigueur le 1er janvier 2012, a eu pour effet, dès le 1er janvier 2015, d’exclure des milliers de personnes de leurs droits aux allocations d’insertion. Très vite, certains praticiens se sont interrogés sur la comptabilité de cette mesure avec l’article 23 de la Constitution et le principe du standstill qui en découle. En effet, ce principe s’oppose à ce que le législateur réduise le niveau de protection sociale dont bénéficient déjà les justiciables à ce moment là. Néanmoins, ce principe n’est pas absolu, ce qui signifie que des reculs peuvent être admis, à condition qu’ils soient justifiés. Les premières décisions des juridictions du travail à ce sujet ont été rendues. Si certaines ont conclu à l’inconstitutionnalité de la mesure, d’autres ont donné raison à l’ONEm. En définitive, on peut dire que la jurisprudence est assez partagée sur cette question difficile. Il faudra donc attendre que la Cour de cassation se prononce sur cette question afin de pouvoir y voir plus clair. Ensuite, peut-être pourra-t-on conclure définitivement à l’inconstitutionnalité de cette mesure.

This book examines patterns of political engagement of long-term unemployed youth. The authors show how unemployment affects the personal, social, and political life of young people. Focusing on the case of Geneva in Switzerland, the study shows the importance of socioeconomic, relational, psychological, and institutional resources for the political engagement of unemployed youth. The book shows specifically how the relationship between unemployment and the political engagement of unemployed youth is mediated by a number of factors: their socioeconomic status and more generally their individual background, their level of deprivation and the associated degree of subjective well-being; the social capital that unemployed youth draw from involvement in voluntary associations and interpersonal networks and relations, and the political learning stemming from interactions with welfare institutions and their perception of such interactions. Students and scholars in areas including Sociology, Political Science, Economics, Youth Studies and Social Policy will find this study of interest.
