Abstract

The Charter of Fundamental Rights of the European Union enshrines the key political, social and economic rights of EU citizens and residents in EU law. In its present form it was approved in 2000 by the European Parliament, the Council of Ministers and the European Commission. However its legal status remained uncertain until the entry into force of the Treaty of Lisbon in December 2009. The Charter obliges the EU to act and legislate consistently with the Charter, and enables the EU's courts to strike down EU legislation which contravenes it. The Charter applies to EU Member States when they are implementing EU law but does not extend the competences of the EU beyond the competences given to it in the treaties. This Commentary on the Charter, the first in English, written by experts from several EU Member States, provides an authoritative but succinct statement of how the Charter impacts upon EU, domestic and international law. Following the conventional article-by-article approach, each commentator offers an expert view of how each article is either already being interpreted in the courts, or is likely to be interpreted. Each commentary is referenced to the case law and is augmented with extensive references to further reading. Six cross-cutting introductory chapters explain the Charter's institutional anchorage, its relationship to the Fundamental Rights Agency, its interaction with other parts of international human rights law, the enforcement mechanisms, extraterritorial scope, and the all-important 'Explanations'--

Abstract

The entry into force of the Treaty of Lisbon in 2009 caused the EU's Charter of Fundamental Rights to be granted binding effect. This raised a host of intriguing questions. Would this transform the EU's commitment to fundamental rights ? Should it transform that commitment ? How, if at all, can we balance competing rights and principles ? (The interaction of the social and the economic spheres offers a particular challenge). How deeply does the EU conception of fundamental rights reach into and bind national law and practice ? How deeply does it affect private parties ? How much flexibility has been left to the Court in making these interpretative choices ? What is the likely effect of another of the reforms achieved by the Lisbon Treaty, the commitment of the EU to accede to the ECHR ? This book addresses all of these questions in the light of five years of practice under the Charter as a binding instrument

Abstract

En même temps que le traité de Lisbonne conférait valeur juridique contraignante à la charte des droits fondamentaux de l’Union européenne, il a créé, par l’article 67, paragraphe 1, du traité sur le fonctionnement de l’Union européenne, une obligation pour l’Union et les États membres de respecter les droits fondamentaux dans la construction de l’espace de liberté de sécurité et de justice. Parce qu’il vise chacune des normes composant cet espace, ce commandement interroge particulièrement dans l’espace judiciaire européen en matière civile et commerciale où les règles de coordination des ordres juridiques nationaux sont partiellement réfractaires à l’influence des droits fondamentaux. Toutefois, la polysémie de la notion de respect permet d’envisager divers modes d’articulations de la charte et du droit de l’espace judiciaire européen en matière civile et commerciale. Si le principe hiérarchique paraît la modalité la plus évidente pour assurer le respect de la charte, il s’avère inapte à y parvenir, tant par lui-même que par le contexte spécifique d’application de la charte qu’impose l’espace judiciaire européen. Aussi conviendrait-il de la compléter par un mode d’articulation plus souple, la combinaison, afin de parvenir à conformer la construction de l’espace sous étude à l’article 67, paragraphe 1, du traité sur le fonctionnement de l’Union européenne.

Abstract

This is the first comprehensive analysis of the extent to which the Charter of Fundamental Rights of the European Union will influence the development of contract and commercial law at a European level. The essays in this volume examine how the Court of Justice has already used the Charter to steer the law governing consumer transactions, financial contracts, contracts of employment, self-employment, tenancies, and other contractual arrangements. They then proceed to assess the likely future impact of the Charter on EU contract law, using a variety of legal, historical, and theoretical perspectives. These original assessments by distinguished scholars range from claims that the Charter will only have a mild indirect influence to arguments that the Charter provides the necessary legal foundations for EU contract law and for a market society within a multi-level system of governance. Questions are raised about the scope of application of the Charter; its indirect but significant effect on national legal systems, especially in improving the effectiveness of EU law; and whether the rights and principles of the Charter may sometimes have direct effect on contracts by leading a court to disapply national law. Abstract

This book analyses the accountability of European home States for their failure to secure the human rights of victims from host States against transnational enterprises. It argues for a reconfiguration of the relationship between multinational enterprises and individuals, both of which have been profoundly changed by globalisation. Enterprises are now supranational entities with numerous affiliates all over the world. Likewise, individuals are increasingly part of a global community. Despite this, the relationship between the two is deregulated. Addressing this gap, this study proposes an innovative business and human rights litigation strategy. Human rights advocates could file a test case against a European home State, at the European Court of Human Rights, for its failure to secure the rights of victims vis-à-vis European multinational enterprises. The book illustrates why such a strategy is needed, and points to the lack of effective legal remedies against European multinationals. The goal is to empower victims from developing countries against European States which are failing to hold multinational enterprises accountable for human rights abuses.
