This book provides a brief intellectual and constitutional history of the Article V amending process from the Imperial Crisis until the present and shows Article V to be a vital part of the Constitutional architecture. Furthermore, it defends Article V from critics who claim it is too difficult, undemocratic, and too formal; and it makes the case for Article V as the sole legitimate form of Constitutional amendment.

L'Union européenne est arrivée, au tournant du siècle, à un cap de son histoire. Après cinquante ans de construction au coup par coup, elle se prépare à s'étendre à l'ensemble du continent, à réformer ses institutions et à définir son modèle économique et sociale. Rien d'étonnant, dès lors, à ce que l'idée de la doter l'Union européenne d'une constitution refasse surface. Les plus hauts dirigeants politiques français et allemand ont lancé un débat constitutionnel qui suscite d'amples discussions. Écrire une constitution pour l'Europe constitue en effet une entreprise ambitieuse, qui ne va pas sans poser quelques questions fondamentales. Elles concernent d'abord la méthode. Comment peut-on doter l'Union européenne, qui n'est pas et n'a pas vocation à devenir un État, d'une constitution ? Cette tâche doit-elle revenir aux gouvernements, ou les parlements et les peuples doivent-ils y être associés ? Est-ce un texte radicalement neuf, procédant à une refondation de l'Union, qu'il convient d'établir, ou s'agit-il plus modestement de mettre au clair une constitution implicite, léguée par un demi-siècle d'intégration ? Dans quelle mesure l'acquis historique, et les modèles politiques que les États européens ont en partage, déterminent-ils le processus constituant ? Le contenu qu'une telle charte fondamentale pourrait recouvrer soulève lui aussi de profondes interrogations. Quels seront les principes fondateurs de l'Union et quels droits y seront conférés aux citoyens ? Les agencements institutionnels existants satisfont-ils aux ambitions constitutionnelles du temps, ou doivent-ils être modifiés pour atteindre plus de démocratie et d'efficacité ? Comment l'Union peut-elle poursuivre des objectifs communs tout en préservant l'identité de ses États et de ses peuples ? Telles sont les principales questions auxquelles a tenté de répondre une équipe internationale de politistes, juristes et philosophes.

Trotz der Arbeiten des EU-Verfassungskonvents zweifeln viele an der Möglichkeit europäischer Verfassunggebung, weil die EU kein Staat ist und es kein einheitliches EU-Volk gibt.Tobias Herbst untersucht, wie Hoheitsgewalt durch Verfassunggebung legitimiert werden kann. Dabei kritisiert er die simplifizierende "urheberorientierte" Vorstellung, dass legitime Verfassunggebung auf ein einheitliches, souveränes Staatsvolk zurückgehen müsse. Unter Rückgriff auf die Verfassungstheorien der Amerikanischen und der Französischen Revolution und auf die Theorie des Gesellschaftsvertrages entwirft Herbst ein Prinzipienmodell der Verfassunggebung mit drei zum Teil gegenläufigen Legitimitätsprinzipien: Freiheitssicherung, kollektive Autonomie und dauerhafte Konsensfähigkeit. Aus diesem Modell lassen sich Aussagen über die Legitimität staatlicher und supranationaler Verfassungen gewinnen. Europäische Verfassunggebung ist demnach jedenfalls möglich und setzt kein einheitliches, souveränes EU-Volk voraus.Das Buch erhellt den staatsphilosophischen Hintergrund der gegenwärtigen Diskussion über eine Europäische Verfassung und spricht damit Juristen, Politikwissenschaftler und interessierte Laien an.
