La procédure judiciaire constitue souvent une épreuve douloureuse pour les personnes qui s’y trouvent confrontées et ce, quelle que soit la matière sur laquelle porte le litige. À l’heure actuelle, de plus en plus de justiciables attendent de leur conseil une manière d’appréhender leur litige qui serait conforme à leurs besoins plutôt que de se voir imposer des solutions souvent inadaptées, allant à l’encontre de leurs intérêts personnels. Parmi les différents modes alternatifs de résolution des conflits, nous estimons que le droit collaboratif – pourtant trop peu connu du grand public - constitue sans doute la meilleure solution permettant aux justiciables, souvent confrontés à des situations compliquées, d’être éclairés et soutenus par leur conseil tout au long de ce processus. Serait-il opportun d’en faire une alternative obligatoire à la procédure judiciaire ? Dans l’affirmative, faudrait-il en faire un préalable obligé à toute action en justice ou faudrait-il « simplement » donner la possibilité au juge d’imposer aux parties le recours à ce processus compte tenu des circonstances du litige qui se présente à lui, une fois la procédure judiciaire engagée ? L’existence d’un « droit collaboratif obligatoire » suscite donc de nombreuses questions tant d’ordre juridique, que d’ordre pratique. Pour tenter d’y apporter des réponses, un bref détour par le processus de la médiation judiciaire semble tout d’abord nécessaire, détour permettant, par la suite, de comprendre que la réflexion tenue en matière de médiation judiciaire peut, sur de nombreux points, tout à fait être transposée à la matière du droit collaboratif.

The central point of this book concerns three main issues : the problems of WTO retaliation, the question of the effectiveness of retaliation, and the purposes of retaliation. WTO retaliation is often deemed ineffective due to its inherited shortcomings. This book highlights the significance in identifying the purposes of retaliation prior to evaluating its effectiveness. Put differently, it refers to the purpose-based approach of effectiveness. It is a common understanding that the purpose of WTO retaliation is to induce compliance. This book, nevertheless, argues in favour of coexistence of the multiple purposes of retaliation, including reaching a mutually agreeable solution. These views are based on the extensive research conducted on the purposes of WTO retaliation, namely through interpreting Article 22 of the DSU ; examining the remedies rules within the frameworks of public international law, and law and economics ; and assessing the academic writings/debates as well as the statements of arbitrators. Finally, by evaluating a number of disputes involving WTO retaliation, this book demonstrates the reasonableness and soundness of WTO retaliation in light of its multiple purposes.

Par une importante réforme du Code judiciaire de 2018, le législateur invite les acteurs de la justice à favoriser le règlement amiable des conflits. La posture naturelle de beaucoup de magistrats, et parmi eux les juges de paix, de favoriser le règlement amiable à tous stades de la procédure est devenu norme légale. Cet ouvrage comprend neuf contributions. Il s’intéresse non seulement à la conciliation judiciaire, chère au juge cantonal, mais permet également de découvrir d’autres modes de règlement amiables (comme la médiation et le droit collaboratif) et offre des outils théoriques et pratiques permettant aux juges et aux acteurs de la justice de comprendre les enjeux et le cadre légal de leur intervention ainsi que de mieux se positionner comme acteurs d’une justice désormais plurielle, qui ne peut plus être exclusivement contentieuse.

Les modes amiables de résolution des litiges en droit de l’entreprise, droit du travail et droit de la famille et les alternatives au procès pénal Ces dernières années, les alternatives au procès ont particulièrement le vent en poupe. Que ce soit par le développement des modes alternatifs de résolution des litiges ou encore par la promotion des alternatives au procès pénal, notre système juridique évolue, tout comme la pratique du règlement des différends, et se dote d'une multitude de dispositifs parfois encore méconnus des praticiens. Dans un premier temps, les auteurs se consacreront à l'étude des alternatives au procès civil en se penchant sur les principaux modes amiables de règlement des conflits et leurs spécificités en droit de l'entreprise, du travail et de la famille. Dans un second temps, l'ouvrage abordera les enjeux et perspectives des alternatives au procès pénal ainsi que les réflexions qu'elles suscitent au travers de leur pratique. Une dernière contribution portera sur la médiation réparatrice permettant de clôturer cette analyse des nouvelles formes alternatives de justice.
