This book focuses on the protection of abducting mothers who have been subject to return proceedings under the 1980 Hague Abduction Convention and the Brussels IIa Regulation, in circumstances where the child abduction has been motivated by acts of domestic violence from the left-behind father. The utility of Regulation 606/2013 on mutual recognition of protection measures in civil matters and Directive 2011/99/EU on the European Protection Order, and how protection measures can be used to protect abducting mothers, are examined within this context. Both instruments allow cross-border circulation of protection measures but, so far, have not attracted much attention in practice. This book aims to fill that gap.Domestic Violence and Parental Child Abduction is the culmination of the POAM (Protection of Abducting Mothers in Return Proceedings) project, a collaborative research project conducted between 2019 and 2021. It presents and analyses the findings of the project and brings together contributions by the project partners, as well as by other renowned experts. The book also presents a Best Practice Guide developed for the application of Regulation 606/2013 and Directive 2011/99/EU in child abduction cases committed against the background of domestic violence. The book offers a unique perspective on the problem of international parental child abductions committed against the background of domestic violence. Given its practical focus, it will appeal not only to an academic audience but also to judges, legal practitioners and other professionals working in the area of parental child abduction.

Phénomène globalement en augmentation, le déplacement d’un enfant par l'un de ses parents constitue une infraction s’il est fait en violation d’un droit de garde attribué par le droit de l’État dans lequel l’enfant avait sa résidence habituelle immédiatement avant son déplacement ou non-retour et que ce droit était exercé effectivement au moment du déplacement. Le droit applicable au déplacement illicite d'enfants par un parent est rendu extrêmement complexe par la composante internationale de certains conflits familiaux. Dans ces hypothèses trouveront à s'articuler le droit interne de chaque État, mais aussi le droit régional et le droit international liant ces États.Ce guide propose une présentation synthétique des principaux instruments juridiques en droit international et européen relatifs au déplacement international illicite d’enfants. Quant aux droits internes, applicables en dehors de tout engagement conventionnel, et devant l’impossibilité de les étudier tous, ils seront abordés en particulier via le droit international privé français et belge, où les cas sont nombreux selon les dernières données statistiques disponibles. Des exemples issus du droit suisse et luxembourgeois seront également présentés.Les quatre chapitres offrent une présentation du régime applicable selon les engagements qui lient – ou non – les États concernés par la situation. Le premier chapitre présente le droit conventionnel multilatéral, avec les principaux instruments relatifs au déplacement international illicite d'enfants, ainsi que leur articulation. Le deuxième chapitre concerne le droit de l’Union européenne, et en particulier le Règlement Bruxelles IIbis. Le troisième chapitre expose les mécanismes du droit conventionnel bilatéral, en s’appuyant sur les exemples français, belge et suisse. Enfin, le dernier chapitre présente les principaux mécanismes de droit international privé applicables en l’absence de toute convention entre les États concernés par la situation de déplacement illicite.
