In deze studie worden de achtergronden, plaats en betekenis van 'contextgebonden excepties' in het commune strafrecht verkend en wordt beoordeeld in hoeverre de vaststelling van uitsluiting van strafrechtelijke aansprakelijkheid op een systematische wijze plaatsvindt. Veelvuldig worden gedragingen verricht die ogenschijnlijk de bestanddelen van een wettelijke delictsomschrijving vervullen, terwijl het nog maar de vraag is of dergelijke gedragingen ook daadwerkelijk strafwaardig of strafbaar zijn. Zulke gedragingen vinden menigmaal plaats in 'bijzondere contexten', zoals de sport- en spelsituatie, de kunst en de (medische) beroepsuitoefening. Zo kan de vraag worden opgeworpen of en langs welke wegen er sprake moet zijn van uitsluiting van strafrechtelijke aansprakelijkheid wanneer in die bijzondere contexten een voetballer zijn tegenstander heeft geblesseerd, een kunstenaar een aanstootgevend werk heeft gemaakt en een arts pijn toebrengt bij een behandeling. De strafrechter heeft bij een dergelijke beoordeling weinig wettelijk houvast en uit de jurisprudentie valt op te maken dat hij (als gevolg daarvan) op verschillende, uiteenlopende wijzen tot straffeloosheid komt. In deze studie worden de achtergronden, plaats en betekenis van 'contextgebonden excepties' in het commune strafrecht verkend en wordt beoordeeld in hoeverre de vaststelling van uitsluiting van strafrechtelijke aansprakelijkheid op een systematische wijze plaatsvindt. Daarmee wordt tevens geïllustreerd of die wijze ook toereikend is om recht te doen aan de bijzonderheid van de contexten waarin de gedragingen zich voordoen. De daaruit volgende conclusies en aanbevelingen strekken ertoe de systematiek in de rechterlijke vaststelling te bevorderen, hetgeen de belangen dient van participanten in die bijzondere contexten, alsmede van actoren in de strafrechtspleging.
