Le droit des religions en Europe a pris un nouvel élan suite aux interrogations générées par les importantes transformations du paysage religieux contemporain marqué à la fois par un processus de sécularisation des religions historiques et une expansion de nouvelles minorités religieuses. De nombreux ouvrages analysant les conséquences juridiques de ce phénomène ont paru au cours de ces dernières décennies. Mais contrairement à d’autres secteurs du droit, il n’existe pas à ce jour de recueil réunissant à la fois les textes de droit français, de droit international et de droits étrangers des religions introduits par une présentation des éléments essentiels du statut juridique des cultes des différents pays européens. Des membres de l’équipe PRISME - Société, Droit et Religion en Europe ont relevé ce défi et publié ce volume indispensable pour tous ceux qui s’intéressent aux modes de régulation normative du phénomène religieux.

This book contains the documentation from the 19th meeting of the European Consortium for Church and State Research, which was held in Nicosia, Cyprus on 15 - 18 November 2007. The aim of the conference was to provide an overview of the different legal ways in which the member states of the European Union interpret in their domestic legal orders, the provisions of the European Convention on Human Rights which relate to religious freedom.

Les rapports entre l'Etat et les Eglises ont brutalement rebondi depuis quelques temps, alors que l'on pouvait penser que le principe de la laïcité s'était définitivement imposé, la liberté de religion et de son expression étant, quant à elle, garantie par différents instruments juridiques internationaux. La polémique sur l'inscription d'une référence au christianisme dans le préambule de la Charte des droits fondamentaux de l'Union européenne ainsi que dans celui du Traité établissant une Constitution pour l'Europe, comme la controverse relative au port du voile, ont incité l'Institut de droit européen des droits de l'homme de l'Université de Montpellier I à organiser un colloque de réflexion sur l'ensemble des questions touchant à la religion, au pluralisme et à la laïcité. L'ouvrage reproduit les contributions analysant ces questions tant aux Etats-Unis que dans tes Etats européens et notamment dans les jurisprudences de la Cour suprême fédérale américaine et de la Cour européenne des droits de l'homme.
