Abstract

The Annotated Digest of the International Criminal Court, 2008 , is the third volume in an annual series, which compiles a selection of the most significant legal findings from public decisions rendered by the International Criminal Court in 2008. A total of 472 public decisions were reviewed for the preparation of this volume. The selected abstracts include an extraordinary number of landmark decisions on substantive and procedural issues including, among others, the constitutive elements of crimes against humanity and war crimes, the rights of victims to participate in different stages of proceedings, the guarantees of a fair trial, and the prosecutorial obligation to disclose potentially exculpatory evidence in its possession. The year was marked by two new arrests, one in the situation from the Democratic Republic of Congo (Ngudjolo), the other in the situation from the Central African Republic (Bemba), as well as confirmation of charges in the joint case The Prosecutor volume Katanga and Ngudjolo . Finally, 2008 paved the way for commencement of the first trials in the history of the International Criminal Court, which officially began in 2009. Abstracts included in this series were selected based on the following criteria: (i) clarification of a legal issue or interpretation of a legal provision; (ii) implementation or application of a legal provision; and (iii) meaningfulness with respect to international justice, human rights, or international humanitarian law. Passages are normally quoted in English, except where the English translation has not been made available; in such circumstances, abstracts are provided in French with an accompanying English-language summary. Selected abstracts are organized under the relevant Statute, Rule of Procedure and Evidence, or Regulation of the Court. A short description or summary is provided for each topic, and a reference system and index allow for easy reference to other decisions quoted in the Digest series.

Abstract

With the ad hoc tribunals completing their mandates and the International Criminal Court under significant pressure, today's international criminal jurisdictions are at a critical juncture. Their legitimacy cannot be taken for granted. This multidisciplinary volume investigates key issues pertaining to legitimacy: criminal accountability, normative development, truth-discovery, complementarity, regionalism, and judicial cooperation. Abstract

Accounts of international criminal courts have tended to consist of reflections on abstract legal texts, on judgements and trial transcripts. Genocide Never Sleeps, based on ethnographic research at the International Criminal Tribunal for Rwanda (ICTR), provides an alternative account, describing a messy, flawed human process in which legal practitioners faced with novel challenges sought to reconfigure long-standing habits and opinions while maintaining a commitment to 'justice'. From the challenges of simultaneous translation to collaborating with colleagues from different legal traditions, legal practitioners were forced to scrutinise that which normally remains assumed in domestic law. By providing an account of this process, Genocide Never Sleeps not only provides a unique insight into the exceptional nature of the ad hoc, improvised ICTR and the day-to-day practice of international criminal justice, but also holds up for fresh inspection much that is naturalised and assumed in unexceptional, domestic legal processes.

Abstract

Establishing individual criminal responsibility for mass atrocities is the foundational principle of international criminal justice, but this process is highly complex, and is accompanied by political and legal dilemmas about its operation. The book examines the drafting, interpretation, and application of the rules for assessing individual criminal responsibility as those rules emerge from the intense contestations among judges, lawyers, and academics within the legal field. Focusing on the International Criminal Court (ICC), the book provides a rich analysis of the international debates around questions of criminal responsibility by interrogating formal legal documents and legal scholarship alongside more candid accounts (interviews, memoirs, minutes). These debates are of key importance for international criminal law and global justice because how criminal responsibility laws are construed in practice determines which conduct merits punishment and, ultimately, demarcates the boundaries of what are considered the 'gravest' acts that 'shock' humanity.
