Le présent ouvrage met en lumière l'ampleur du projet du sociologue et juriste allemand Niklas Luhmann (1927-1998), dont la théorie générale de la société défie la sociologie et la philosophie occidentales modernes. Le volume entend donner des repères et des clés de compréhension pour mieux "situer" Luhmann au sein des sciences sociales et de la philosophie, en particulier de la philosophie du droit, en montrant comment sa pensée, réputée "inclassable" , s'inscrit néanmoins dans les champs de recherche de ces disciplines, prend parti dans des débats théoriques et s'inspire, tout en s'en démarquant, d'autres courants de sciences sociales et de philosophie qu'elle discute. Luhmann sociologue, Luhmann juriste, Luhmann philosophe du présent - tels sont les trois angles d'attaque principaux réunissant les différents textes du volume. C'est tout d'abord la discussion qu'assume la théorie de Luhmann avec les fondateurs des sciences sociales qui est restituée et analysée : Emile Durkheim, grâce à une traduction inédite de la préface de Luhmann à La division du travail social, puis Max Weber et Georg Simmel. Dans un deuxième temps, l'actualité de la théorie du droit de Luhmann est soulignée par des contributions s'intéressant à sa position sur la théorie juridique elle-même, sur les droits, sur la justice ou encore sur la question de l'indétermination en droit.
