Gratuitous sex. Graphic violence. Lies, revenge, and murder. Before there was digital cable or reality television, there was Renaissance Italy and the courts in which Italian magistrates meted out justice to the vicious and the villainous, the scabrous and the scandalous. Love and Death in Renaissance Italy retells six piquant episodes from the Italian court just after 1550, as the Renaissance gave way to an era of Catholic reformation. Each of the chapters in this history chronicles a domestic drama around which the lives of ordinary Romans are suddenly and violently altered. You might read the gruesome murder that opens the book-when an Italian noble takes revenge on his wife and her bastard lover as he catches them in delicto flagrante-as straight from the pages of Boccaccio. But this tale, like the other stories Cohen recalls here, is true, and its recounting in this scintillating work is based on assiduous research in court proceedings kept in the state archives in Rome. Love and Death in Renaissance Italy contains stories of a forbidden love for an orphan nun, of brothers who cruelly exact a will from their dying teenage sister, and of a malicious papal prosecutor who not only rapes a band of sisters, but turns their shambling father into a pimp! Cohen retells each cruel episode with a blend of sly wit and warm sympathy and then wraps his tales in ruminations on their lessons, both for the history of their own time and for historians writing today. What results is a book at once poignant and painfully human as well as deliciously entertaining.

De rechter bekleedt een specifieke plaats in de samenleving: hij of, meer en meer, zij heeft de grondwettelijke opdracht om geschillen te beslechten opdat, liefst zo snel mogelijk, een einde wordt gesteld aan onenigheden tussen individuele burgers onderling, tussen burgers en bedrijven, tussen dezen en de overheid, tussen consumenten en professionals. De rechter bekleedt daarmee in essentie een pacificerende functie in de samenleving. Hij beschikt over een uitgebreid arsenaal aan wetten om zijn opdracht te volbrengen: wanneer de wet correct werd toegepast is zijn missie vervuld. Althans volgens de post-revolutionaire visie die in de rechter niets anders zag dan 'la bouche de la loi', als dam tegen de willekeur van despotische monarchen. De westerse samenleving is gedurende de laatste twee eeuwen verder geëvolueerd, democratischer geworden met meer aandacht voor de zwakkeren: de verzorgingstaat wil tegemoet komen aan diegenen die minder kansen kregen in het leven. Ook de rechterlijke macht (in zijn enge maar enige juiste betekenis) evolueerde: waar de magistratuur tot voor enkele decennia alleen voorbehouden was voor telgen uit de bourgeoisie (en haar ideeëngoed) kwamen sinds de zeventiger jaren zonen en dochters uit alle lagen van de bevolking (met vernieuwende en meer uiteenlopende ideeën) de magistratuur bemannen. Ook het aantal geschillen nam in die periode enorm toe: burgers van alle slag, geëmancipeerd en geïnformeerd, vonden de weg naar de rechtbanken. De rechter kreeg door de lawine aan wetgeving die de nieuwe samenleving vereiste een breder speelveld maar ook meer armslag: bovendien evolueerde de impact van de rechterlijke uitspraak van eerder maatschappijbestendigend naar maatschappelijk richtinggevend. En is de invloed van de rechter op de samenleving gegroeid.

Au cœur des milliers de pages que lui doivent, et lui devront encore, le droit judiciaire et ses adeptes, le Professeur Closset-Marchal tourne aujourd’hui celle de son accès à l’éméritat. Sa pudeur et sa modestie l’éloignant de toute ostentation, ses proches collègues affectueusement secondés par sa tribu familiale ont pris l’initiative d’un hommage digne de la carrière que, quarante années durant, elle a menée à et pour l’Université catholique de Louvain. Héritière des prédilections de son maître, le regretté Cyr Cambier, Gilberte Closset-Marchal fait autorité sur les sentiers arides et escarpés de la compétence. Mais si tel est son pré carré, rares sont les notions, les principes, les techniques, traquenards et controverses de l’instance civile auxquels, par ailleurs, cette éminente processualiste ne s’est pas adonnée de son ascétique et limpide écriture. Ses ouvrages et ses chroniques font le miel des praticiens, tandis que la clarté de ses enseignements ont enchanté les quelque vingt-mille étudiants qu’elle aura instruits des sources, principes et méthodes du droit, puis des arcanes du procès. Tour à tour présidente de jury, présidente du Centre Charles Van Reepinghen puis du département de droit privé et encore vice-présidente du prestigieux Centre interuniversitaire de droit judiciaire, notre jubilaire a par ailleurs fait montre d’un dévouement remarquable. Au gré de ce parcours exemplaire, le Professeur Closset-Marchal aura, partout dans le pays, mais aussi bien ailleurs comme à Milan ou Heidelberg, noué de nombreux liens qui, aujourd’hui, s’expriment en une manière de somme. Le choix du fil conducteur de ce recueil d’hommages s’imposait comme une évidence: les rapports complexes qu’entretiennent le droit, la justice et le temps, auxquels notre chère collègue a consacré sa thèse de doctorat, puis d’autres contributions de référence.
