Abstract

L'histoire est riche en périodes au cours desquelles la dénonciation fut un véritable moyen de gouvernement. Elle apparaît lors des moments de crise de la démocratie ou de façon plus systématique avec les régimes totalitaires. Des sycophantes de la Grèce antique à Pavlik Morozov en passant par le Maccarthysme, la dénonciation ressurgit comme un fléau à chaque fois que l'autre devient un ennemi réel ou potentiel. Et pourtant la dénonciation demeure un phénomène aussi omniprésent que caché. Ses visages sont multiples et souvent ignorés. C'est en particulier le pilier essentiel de tout système judiciaire. La justice ne fonctionne en effet qu'à travers des flux d'informations prenant des noms divers mais constituant tous des formes de signalement. Le dénonciateur s'appelle alors plaignant, témoin, indicateur de police, repenti, etc. Autant de personnages qui, sous des habillages différents, dénoncent. La loi tente donc d'organiser et de canaliser la dénonciation à travers un faisceau de textes. Certaines formes de dénonciations sont punies, d'autres sont obligatoires et même parfois encouragées. Le dénonciateur est tour à tour pourchassé ou protégé en fonction des prescriptions de la loi. La dénonciation, enfin, mérite-t-elle l'opprobre qui l'entoure habituellement ? N'est-ce pas un acte de solidarité et de civisme ? Peut-on assimiler dénonciation et délation ? Pourquoi préfère-t-on parfois le silence à la parole ? Autant de questions à explorer
