En 1593 el juez visitador Mateo Alemán fue encargado de realizar una visita a la mina de mercurio de Almadén en España para inspeccionar e informar sobre la situación de sus trabajadores, presos forzados de la Corona que, condenados inicialmente a galeras, habían sido derivados a trabajar en la explotación de azogue. El Informe fue atajado de raíz y su autor retirado del caso un mes después de comenzada la tarea, el trabajo quedó perdido en los archivos de los Austrias. Pocos años después, en 1599, Alemán publica con enorme éxito editorial El Guzmán de Alfarache, la historia de un galeote que comparte sus cuitas con el mundo. En este trabajo, la autora analiza el contexto histórico, político y jurídico de ambos textos como ejemplo de la tensión simbiótica entre el Derecho y la Literatura. Lo que el informe jurídico no logró por intereses personales de la Corona, fue abordado por la novela, donde Alemán usó sabia y subversivamente el Derecho, para exponer así una demanda formal contra la sociedad, dejando a la discreción del lector la sentencia para el pícaro. De esta idea surge una conciencia de la Literatura como precedente jurisprudencial enormemente válido para el impulso del proceso legislativo y judicial. Una nueva jurisprudencia, precedente pausado y tenaz que moldea las decisiones de los hombres y mujeres, y con ellas, la sociedad entera.

"Of all the divinities of classical antiquity, the Greek Hermes (Mercury in his Roman alter ego) is the most versatile, enigmatic, complex, and ambiguous. The runt of the Olympian litter, he is the god of lies and tricks, yet is also kindly towards mankind and a bringer of luck. His functions embrace both the marking of boundaries and their transgression, but also extend to commerce, lucre, and theft, as well as rhetoric and practical jokes. In another guise, he plays the role of mediator between all realms of human and divine activity, embracing heaven, earth, and the netherworld. 0Pursuing this elusive divinity requires a truly multidisciplinary approach, reflecting his prismatic nature, and the twenty contributions to this volume draw on a wide range of fields to achieve this, from Greek and Roman literature (epic, lyric, and drama), epigraphy, cult, and religion, to vase painting and sculpture.
