Wie kann sich das Recht auf die Herausforderungen wachsender Staatsaufgaben einstellen, welche Rolle kommt ihm in der modernen Risikogesellschaft mit ihren sich rapide wandelnden Problemlagen zu? Das Werk gibt Antworten auf diese Fragen, die auch darüber entscheiden, ob das aufklärerische Modell einer freiheitlichen Verfassung von Staat und Gesellschaft bewahrt und fortentwickelt werden kann. Hierzu entwirft der Verfasser die Theorie eines prozeduralen Rechts, die er an aussagekräftigen Beispielen zum Modell eines prozeduralen Rechtsstaats konkretisiert.Calliess stellt zunächst verschiedene Ansätze zur Prozeduralisierung des Rechts vor und baut diese zu einer Theorie des Rechts als Kommunikationssystem in der Kommunikationsgesellschaft aus. Die im Bereich von Humangenetik und Gentechnik ins Leben gerufenen Ethikkommissionen bzw. Kommissionen für biologische Sicherheit dienen dem Verfasser als Beispiele, um die zuvor entwickelte Theorie des prozeduralen Rechtsstaat und insbesondere das Verhältnis von Autonomie und Kontrolle im prozeduralen Rechtsverständnis zu präzisieren.Insgesamt gelingt es ihm, unterschiedliche Ansätze der Rechtstheorie und der Sozialwissenschaft so zusammenzuführen, daß ein Konzept prozeduralen Rechts entsteht, das seinerseits anschlußfähig für die juristische Dogmatik ist.

This collection of papers from the Twentieth British Legal History Conference explores the relationship between substantive law and the way in which it actually worked. Instead of looking at what the courts said they were doing, it is concerned more with the reality of what was happening. To that end, the authors use a wide range of sources, from court records to merchants' diaries and lawyers' letters. The way in which the sources are used reflects the possibilities of legal historical research which are opening up in the twenty-first century, as large databases and digitised images - and even online auction sites - make it a practical possibility to do work at a level which was almost unthinkable only a short time ago.

Despite European integration, judicial procedure has long remained autonomous, i.e. a purely national regulatory object. In recent years, however, it has been possible to notice increasing traces of the Europeanization of procedural law on multiple levels. The rapid internationalization development of procedural law advancing on these various levels sets challenges to the research of procedural law, as well as to the conduct of judicial procedure. This book consists of a number of independent, but interrelated, theses and post-doctoral research projects. The comprehensive research in this collection examines the challenges that are now taking place in the Europeanization of procedural law.
