L'installation d'un réseau européen Natura 2000 est un objectif prépondérant de la politique environnementale. La désignation des zones de protection spéciale et des zones spéciales de conservation se révèle particulièrement délicate. Une difficulté majeure est d'articuler ce zonage protecteur de la nature et le droit individuel de propriété. La question a paru à ce point sensible aux membres de l'Observatoire Nature 2000 qu'il fut décidé d'y consacrer un colloque international. Un questionnaire a été proposé aux rapporteurs des États membres. Lors d'une réunion qui s'est tenue dans les locaux de l'Université de Thessalie, à Volos (Grèce), les 14 et 20 mars 2004, un rapport de synthèse a été présenté et des discussions approfondies ont eu lieu. Le présent ouvrage rassemble les rapports nationaux, révisés à la suite du colloque, dans la langue anglaise ou française de leur rédaction, le questionnaire et un nouveau rapport de synthèse établis dans les deux langues.

Constructing European Intellectual Property offers a comprehensive assessment of the current state of intellectual property legislation in Europe and gives direction on how an improved system might be achieved. This book covers five areas of family property law in Europe:- Matrimonial Property Law in Europe,- Family Contracts - Issues of Autonomy,- Protection of Older People in Law,- Freedom of Testation and Protection of Family Members, and - Unification of Private International Law.All of these issues are highly relevant as Europe is at a key stage in its development, with all societies experiencing broadly similar demographic trends and facing the social and legal policy challenges that accompany them. The increase in international mobility and multi-jurisdiction couples poses both increased pressure to provide private international law solutions, and prompts calls for substantive harmonisation. The high divorce rate in many jurisdictions means that matrimonial property and maintenance issues affect more families. Other social changes, such as increased maternal labour market attachment, invite reconsideration of the basis for financial relief between spouses on divorce. All jurisdictions are also experiencing growth in cohabitation and extra-marital births. In short, family structures are becoming more complex. This raises questions concerning the division of property both on separation and on death, where the appropriate priority amongst the diverse range of surviving family members needs to be resolved. En dépit (ou à cause) des crises qu’elle traverse, l’Union européenne apparaît comme une forme d’organisation politique originale. S’appuyant sur une analyse des actions de l’Union et sur la jurisprudence de la Cour de justice de l’Union européenne, cet ouvrage lance une proposition doctrinale ; n’assiste-t-on pas à la reconnaissance de droits fondamentaux aux Etats-membres de l’Union européenne ? Une réponse positive à cette question permettrait de mettre en évidence un véritable «marqueur juridique » de l’originalité de l’Union européenne, à partir du statut d’Etat-membre. C’est sur cette proposition que s’interrogent des juristes de plusieurs disciplines, autour des thèmes de l’identité et de la solidarité.
