La récente polémique franco-chinoise sur la restitution de bronzes du Palais d'Été, celle sur les Cariatides du Parthénon, ou encore la restitution des momies égyptiennes illustrent le débat de plus en plus vif qui oppose les pays « spoliés » aux pays, musées et collectionneurs « détenteurs » d'œuvres d'art considérées comme universelles. Le livre d'Emmanuel Pierrat pose la question : quelle est la légitimité de ces revendications ? Sont-elles seulement l'expression de la volonté de récupérer un patrimoine pillé autrefois par les Européens ? Au-delà des querelles sur la conservation des œuvres d'art et leur mise à disposition du public, ces revendications sont devenues un enjeu politique majeur et un point de friction « culturelle » avec des États qui veulent récupérer leur histoire. Dans ce texte percutant et parfaitement informé, l'auteur expose aussi la position de la France et ses ambiguïtés : elle n'a ratifié qu'en 1997 le traité international adopté le 14 novembre 1970 à Paris et n'a toujours pas ratifié la Convention « Unidroit » de 1995 sur les biens culturels volés ou illicitement exportés. Nul ne s'étonnera que la patrie des Arts et des Lettres traîne des pieds : les collections publiques contiennent trop d'œuvres pillées au gré des invasions et de la colonisation – sans même évoquer la Shoah. Problème complexe mêlant droit, morale, argent, préjugés, et conservatisme, la restitution des œuvres d'art est abordée ici de façon érudite et émaillée d'anecdotes édifiantes.

Abstract

The recent threats to cultural heritage, including in Iraq, Mali, Nepal, Syria, and Yemen, has led to increased focus on the sources of international cultural heritage law. This volume reflects that this is not a discrete and contained body of law, but rather a diverse one whose components are drawn from-and often developed and contained within-public international law. These `intersections' have formed in two ways: when public international law has been used to provide greater protection for cultural heritage; and when concern for cultural heritage protection or codification of rules within cultural heritage-centric instruments have helped fuel developments within other areas of public international law.

This book offers the first comprehensive scholarly analysis of the current meaning and scope of military necessity - a key concept in the international legal framework for the protection of cultural heritage during armed conflicts since the adoption of the 1954 Hague Convention. Academic discussions commonly view military necessity uniquely through the lens of international humanitarian or international criminal law. In her book, Berenika Drazewska presents a more comprehensive perspective, examining developments across various strands of international law arisen since 1954. This novel approach demonstrates how international cultural heritage law affords a particularly strict meaning to military necessity. As a result, the relative waiver will only be available to belligerents very rarely, in truly extraordinary circumstances. Drazewska's Military Necessity in International Cultural Heritage Law engages a significant issue in this rapidly evolving field of international law, the inclusion of necessity in regulation of the protection of cultural heritage during armed conflict after 1945. Its very inclusion was viewed as a major concession, which is only multiplied because of the difficulties of its application on the ground. This thorny issue has come to the fore again with large-scale cultural losses inflicted during recent armed conflicts. Elegantly written and scholarly in its approach, this book places this question and possible answers to it within the broader sweep of international law and recent developments not only in international humanitarian law, but state responsibility, international criminal law and international criminal law.
