D'une part, dans de nombreux domaines, le juge a expressément reconnu à l'Administration la faculté de purger spontanément les vices des actes qu'elle édicte et des situations qu'elle crée. D'autre part, la jurisprudence puis la législation ont intégré la régularisation à l'office du juge, chargé de susciter l'adoption de mesures correctrices par l'Administration. L'extension du champ de la régularisation et son intégration à l'office du juge invitent d'abord à évaluer la conception traditionnelle de la sanction du principe de légalité. En effet, purger un acte ou une situation de son vice n'est pas une entorse faite à la légalité mais, bien au contraire, un moyen de la rétablir. En ce sens, la régularisation concilie sécurité juridique et légalité de l'action administrative. Elle fournit également un remède à la complexification du droit, à l'accroissement du contentieux ou encore, plus spécifiquement, à la crise du logement en participant à la sécurisation des autorisations d'urbanisme. Le développement de la régularisation invite ensuite à s'interroger sur l'existence d'une véritable notion dotée d'un régime juridique. La régularisation n'a pas encore fait l'objet d'une consécration générale et demeure un ensemble de techniques juridiques diverses, adaptées aux besoins de l'action des opérateurs publics comme privés. Le présent ouvrage propose une réponse à la question de la possibilité de soumettre la régularisation à un corps unifié de règles."
