This new Handbook offers a combination of theoretical, thematic and empirical analyses of the statebuilding regime, written by leading international scholars. Over the past decade, international statebuilding has become one of the most important and least understood areas of international policy-making. Today, there are around one billion people living in some 50-60 conflict-affected, 'fragile' states, vulnerable to political violence and civil war. The international community grapples with the core challenges and dilemmas of using outside force, aid, and persuasion to build states in the wake of conflict and to prevent such countries from lapsing into devastating violence. The ideological function of the postcolonial 'national', 'liberal', and 'developmental' state inflicts various forms of marginalisation on minorities, but simultaneously justifies oppression in the name of national unity, equality and non-discrimination, and economic development. International law plays a central role in the ideological making of the postcolonial state in relation to postcolonial boundaries, the liberal-individualist architecture of rights, and the neoliberal economic vision of development. In this process, international law subjugates minority interests and in turn aggravates the problem of ethno-nationalism. Analysing the geneses of ethno-nationalism in postcolonial states, Mohammad Shahabuddin substantiates these arguments with in-depth case studies on the Rohingya and the hill people of the Chittagong Hill Tracts, against the historical backdrop of the minority question in Indian nationalist and constitutional discourse. Shahabuddin also proposes alternative international law frameworks for minorities.

En juin 1999, le conseil de sécurité de l'ONU octroyait à la Mission des Nations-Unies au Kosovo des pouvoirs inégalés d'administration directe d'un territoire sortant d'un conflit armé. L'objectif était d'ériger un Etat démocratique et de démanteler le mouvement de lutte armée des Albanais du Kosovo, l'UÇK. C'était compter sans la " résistance " des combattants et leur capacité à dévier le projet de statebuilding international au nom de leur aspiration séculaire à la souveraineté. L'Etat construit par la MINUK s'avère finalement hybride : les éléments formels d'un Etat libéral se combinent avec une structure bureaucratique largement redevable à l'UÇK. Sur la base d'archives, d'entretiens et d'observations de terrain, cet ouvrage analyse les interactions ayant eu cours entre les ex-combattants et le personnel international pendant près de quinze ans. Entre coopération et conflit, ces transactions apparaissent constitutives de la dynamique de co-construction du nouvel Etat devenu indépendant en 2008.

"This book critically examines the process of statebuilding by the EU, focusing on its attempts to build Member States in the Western Balkan region. This book analyses the European Union's policies towards, and the impact they have, upon the states of the Western Balkans, and assesses how these affect the nature of EU foreign policy. To this end, it focuses on the tools and mechanisms that the EU employs in its enlargement policy and examines the new instruments of direct intervention (in Bosnia and Kosovo), political coercion (in the case of Croatia and Serbia in relation to the International Criminal Tribunal for the former Yugoslavia), and stricter conditionality in the Western Balkan countries. The book discusses the key aim of this special form of statebuilding, which is to establish functional liberal-democratic states in Albania, Bosnia and Herzegovina, Croatia, Kosovo, Macedonia, Montenegro, and Serbia in order for them to join the EU and to cope with the responsibilities and pressures of membership in the future. However, the authors argue that while the EU sees itself as an international actor that promotes and protects liberal-democratic values, norms and principles, its experiences in the Western Balkans demonstrate how the EU

"This book provides a critical understanding of Europeanization and statebuilding in the Western Balkans, using the notion of everyday practices. This volume argues that it is everyday and mundane events which provide the entry points to showcase a broader set of practices of Europeanization in countries outside the EU. It does this by tracing notions of Europeanization in the everyday statebuilding of Kosovo; Europe Day celebrations in Bosnia and Herzegovina; urban politics in Tirana; and space and place making in Skopje. In doing so, the book shows that everyday events tell us that as much as it is about changing structures, institutions and economic models, Europeanization is also about changing behaviours and ideas in populations at large. At the same time, the work shows that countries outside the EU use everyday events to perform their belonging to Europe. LAccord dArusha constitue un "enjeu" important de la crise 'actuelle' au Burundi. Ce papier donne une analyse des acquis dArusha et suggère comment mieux les protéger à travers des mécanismes institutionnels existants mais à renforcer. Accord politique de nature hybride, lAccord dArusha contient un ensemble de principes constitutionnels qui ont fortement inspiré la Constitution du 18 mars 2005 actuellement en vigueur. Son statut juridique ayant été reconnu par la Cour Constitutionnelle, il serait opportun de clarifier davantage le statut constitutionnel ou supra-constitutionnel du Protocole II de lAccord dArusha. La mise en application de ce texte ne devrait pas dépendre dun soutien politique purement conjoncturel. Deux organes de protection, lun politique lautre juridictionnel, peuvent en assurer le respect. Aussi bien le Sénat que la Cour Constitutionnelle devraient faire lobjet détudes approfondies pour renforcer leur rôle dange gardien de lAccord dArusha. Ce papier lance le débat en formulant quelques suggestions de réformes des compétences de la Cour Constitutionnelle.
