Aux marges du langage de la prière travaillent les langues du pouvoir. Et l’expression de la prière dans les arènes publiques, souvent, permet aux communautés de croyance de s’inscrire dans les territoires du politique. Les études ici réunies interrogent les représentations médiatiques et les communications de la prière et du recueillement. Dans les sociétés laïques, dans les sociétés en guerre, dans les sociétés au moment d’une révolution, la prière s’invite sans complexe dans le débat politique et l’espace public. Qu’il s’agisse d’un rituel républicain dans le cadre des obsèques nationales ou d’une franche propagande dans le contexte de la Grande Guerre, le dire du religieux n’est pas sans conséquence sur le dit de la vie politique. Ces questions sont prises aujourd’hui dans l’actualité de nos sociétés. Avec d’autres mots, et bien évidemment dans d’autres contextes, ces pages poursuivent l’étonnant travail de Marcel Mauss, La prière, que nous avons souhaité publier ici en fin d’ouvrage.

Depuis le tournant du XXIe siècle, des événements importants ont confirmé la place centrale de la laïcité dans le débat social et politique de nombreux pays relevant d’aires culturelles diverses. Au plan social, les questionnements sur la place du religieux dans l’espace public ont pris de l’ampleur, aussi bien en Europe que dans les Amériques et les pays arabes. Les différents régimes juridiques établissent de nouvelles dispositions. Certaines portent sur les signes religieux, d’autres concernent le corps, le genre, la sexualité, la vie. Cet ouvrage, s’appuyant sur des études et des recherches nouvelles, entend établir un bilan approfondi de différentes situations nationales (pays européens, africains, arabes, américains et Japon) avec trois objectifs principaux : d’abord, étudier comment les pouvoirs politiques assurent la liberté de conscience ; ensuite, analyser comment s’opère le rapport entre le droit positif et la norme religieuse ; enfin, approfondir la question des modes de gestion du religieux. Dans chaque pays, les dynamiques sociales et culturelles internes croisent les influences internationales du processus de globalisation, dont l’ouvrage rend également compte.

Religious institutions, such as churches, are founded on organizational structures, constitute distinct entities in human society, and in their capacity as juristic persons are the repositories of rights and obligations. In certain jurisdictions the rights vested in a religious institution include constitutionally protected entitlements, such as the right to privacy, freedom of religion and belief, freedom of expression, freedom of association, and property rights. Religious communities, comprising persons sharing a particular confession of faith, lack an organized structure, do not qualify for legal subjectivity, and can therefore not participate in legal relationships as a distinct juristic entity. Rights associated with a religious community belong to the individual members of the community and can be exercised by those members, either individually or jointly with other members of the group. In international law, religious communities qualify as peoples for purposes of the right to self-determination. The rights belonging to religious institutions and religious communities to a large extent fall within the general enclave of economic, social and cultural rights. Economic and social rights have been singled out as a distinct category of constitutionally protected human rights in the early twentieth century and ultimately find their base in the encyclical Rerum Novarum (1891) of Pope Leo XIII. The Leuven Lectures, focused upon the above, seek to uncover the protection of the rights of religious institutions and religious communities in international law and in the constitutions of a cross-section of the international community of states.

On 9 and 10 February 2017, experts from various backgrounds joined in a seminar organized by the Centre for Migration Law, Jean Monnet Centre of Excellence at Radboud University, Nijmegen in the Netherlands. The seminar focused on issues culminating at the intersection of migration, law and religion.0We aimed to identify the arguments that drive the discussion in situations presenting a conflict of state law and religious norms in the context of migration. Or, in biblical terms, is there an inherent conflict between Romans 13 (submission to governing authorities) and Matthew 25 (love the stranger), and if so, how is this conflict addressed?0In this book, we have included the key contributions to the seminar, thematically organized around four topics: (1) Religious Social Thought; (2) Application of religious freedom; (3) Comparative analysis of religious freedom laws; and (4) Practitioners? views.0We hope this book will crystallize the arguments and drive further discussion on the important issues resulting from the interplay of migration, law and religion.

Les questions liées à l?expression du religieux dans la sphère publique donnent lieu régulièrement à de vifs échanges dans les débats publics. Afin d?en mettre en perspective les enjeux, un colloque international (réuni sous l?égide des ministères de l?Intérieur, des Affaires étrangères en lien avec l?Institut européen en sciences des religions - IES) a permis de préciser le cadre d?application du principe de laïcité en abordant les aspects philosophiques, juridiques et sociologiques liés à la garantie de liberté de conscience et de religion. Sont ainsi examinées : - la sphère de l'État et la dimension de la neutralité dans les sociétés démocratiques ; - la sphère de la société et la régulation des manifestations religieuses dans l'espace public ; - la sphère de l'éducation et ses particularités. Quelques points de comparaison éclairent la diversité des pratiques de pays étrangers qui proposent des modèles alternatifs (Allemagne, Angleterre, Belgique, Canada, Turquie).
