Abstract

Die Stipulation ist eine der bemerkenswertesten Vertragstypen des römischen Rechts. Sie kam zustande, indem der Gläubiger eine Frage formulierte und der Schuldner diese Frage durch die Wiederholung des Verbs bejahte, welches der Gläubiger verwendet hatte. Inhaltlich war eine Stipulation meistens auf die Zahlung von Geld gerichtet. Manchmal verpflichtete sich der Schuldner auch zu anderen Handlungen. In die Stipulationsfrage konnte der Stipulator eine dritte Person hinzufügen, indem er nach der Nennung seiner eigenen Person, die regelmäßig mit dem Personalpronomen mihi geschah, die Konjunktion aut und dahinter den Dritten im Dativ anfügte. Diese dritte Person wird in der Literatur gewöhnlich in Anlehnung an den spätklassischen Juristen Marcian als solutionis causa adiectus oder adiectus solutionis causa bezeichnet. Der solutionis causa adiectus erwarb kein eigenes Recht auf den geschuldeten Gegenstand der Stipulation. An ihn konnte lediglich mit befreiender Wirkung geleistet werden. Gleichzeitig konnte der Gläubiger dem Schuldner ohne dessen Zustimmung die Befugnis nicht mehr entziehen, an den adiectus wirksam zu leisten, sobald die adiectio wirksam vereinbart war. Der Autor untersucht alle überlieferten Quellenstellen, die einen Bezug zu dem solutionis causa adiectus haben und zeichnet damit erstmals ein umfassendes Bild dieser Rechtsfigur.

Abstract

The first comprehensive study of early Celtic cursing, this work analyses both medieval and ancient expressions of Celtic imprecation: from the binding tablets of ancient Britain and Gaul to the saintly maledictions of the early medieval period, and other traces of Celtic stipulation and binding only speculated on in earlier scholarship. It provides the first full overview and analyses of the ancient Celtic use of binding curses (as attested in Old Celticand Latin inscriptions) and examines their mooted influence in later medieval expressions. Ancient finds (among them long Gaulish curse texts, Celtic Latin Curse tablets found from the Alpine regions to Britain, and fragments of Old Brittonic tablets excavated from Roman Bath) are subjected to rigorous new interpretations, and medieval reflections of the earlier tradition are also considered. This is a systematic study of the conceptual framework used by critics and scholars in their discussions of influence in art and literature. Göran Hermerén explores the key questions raised in scholarly debate on the topic: What is meant by "influence"? What methods can be used to settle disagreements about influence? What reasons could be used to support or reject statements about artistic and literary influence? The book is based on descriptive analyses in which the author has tried to make explicit what is said or implied in a number of "ations from scholarly writings on art and literature. Abstract

From Israel's establishment as a state to the Egyptian-Israeli peace treaty, this work analyzes the role of third-party mediators of the Arab-Israeli dispute. What interests prompted the mediators to undertake their efforts? What effect did their intervention have on regional and global power struggles? Did the mediators actually make any difference? In a thorough treatment of the struggle for a negotiated peace, Saadia Touval answers these questions and tests his answers against the existing theories of international relations. Including a discussion of both United States and United Nations attempts at mediation, and providing a detailed picture of American-Israeli relations, he maintains that successful mediators do not have to be impartial. Drawing on official documents, memoirs, and other sources, this book discusses the mediation efforts of Count Folke Bernadotte; Ralph Bunche; the United Nations Palestine Conciliation Commission; President Eisenhower's emissary, Robert Anderson; Gunnar Jarring; the 1971 mission of the African heads of state; and Secretaries of State William Rogers and Henry Kissinger. Finally the author analyzes President Jimmy Carter's mediation, which led to the Camp David accords and the signing of the Egyptian-Israeli peace treaty. Since 1948 various powers have sought to protect their own interests by active assistance to one party or another in the Arab-Israeli struggle. This book shows how those countries and institutions that have attempted to mediate the conflict have also acted out of self-interest.
