Abstract

This book documents the corrosive effect of social exclusion on democracy and the rule of law. It shows how marginalization prevents citizens from effectively engaging even the best legal systems, how politics creeps into prosecutorial and judicial decision making, and how institutional change is often nullified by enduring contextual factors. It also shows how some institutional arrangements can overcome these impediments. The argument is based on extensive field work and original data on the investigation and prosecution of more than 500 police homicides in five legal systems in Argentina, Brazil, and Uruguay. It includes both qualitative analyses of individual violations and prosecutions and quantitative analyses of broad patterns within and across jurisdictions. The book offers a structured comparison of police, prosecutorial, and judicial institutions in each location, and shows that analyses of any one of these organizations in isolation misses many of the essential dynamics that underlie an effective system of justice.

McElvain explores police shootings from a fresh perspective. Abstract

The present book brings together perspectives from different disciplinary fields to examine the significant legal, moral and political issues which arise in relation to the use of lethal force in both domestic and international law. These issues have particular salience in the counter terrorism context following 9/11 (which brought with it the spectre of shooting down hijacked airplanes) and the use of force in Operation Kratos that led to the tragic shooting of Jean Charles de Menezes. Concerns about the use of excessive force, however, are not confined to the terrorist situation. The essays in this collection examine how the state sanctions the use of lethal force in varied ways: through the doctrines of public and private self-defence and the development of legislation and case law that excuses or justifies the use of lethal force in the course of executing an arrest, preventing crime or disorder or protecting private property. An important theme is how the domestic and international legal orders intersect and continually influence one another. While legal approaches to the use of lethal force share common features, the context within which force is deployed varies greatly. Key issues explored in this volume are the extent to which domestic and international law authorise pre-emptive use of force, and how necessity and reasonableness are legally constructed in this context

Abstract

This fifth volume in the New South African Review series takes as its starting point the shock wave emanating from the events at Marikana on 16 August 2012 and how it has reverberated throughout politics and society. Some of the chapters in the volume refer directly to Marikana. In others, the infl uence of that fateful day is pervasive if not direct. Marikana has, for instance, made us look differently at the police and at how order is imposed on society. Monique Marks and David Bruce write that the massacre 'has come to hold a central place in the analysis of policing, and broader political events since 2012'. The chapters highlight a range of current concerns - political, economic and social. David Dickinson's chapter looks at the life of the poor in a township from within. In contrast, the chapter on foreign policy by Garth le Pere analyses South Africa's approach to international relations in the Mandela, Mbeki and Zuma eras. Anthony Turton's account, 'When gold mining ends' is a chilling forecast of an impending environmental catastrophe. Both Devan Pillay and Noor Nieftagodien focus attention on the left and, in different ways, ascribe its rise to a new politics in the wake of Marikana. The essays in NSAR 5: Beyond Marikana present a range of topics and perspectives of interest to general readers, but the book will also be a useful work of reference for students and researchers.

In January 2007, New York City Police Commissioner Raymond W. Kelly wanted to make sure that his department was doing everything necessary to minimize the unnecessary discharge of firearms. He asked the RAND Corporation to examine the quality and completeness of the New York City Police Department (NYPD) firearm-training program and identify potential improvements in the design and delivery of the curriculum, the technology used, the frequency and duration of training sessions, the tactics and procedures on which the training is based, and the police department's firearm-discharge review process. This monograph reports the observations, findings, and recommendations of that study.
