Le Contrôleur général des lieux de privation de liberté (CGLPL) a pour mission de veiller à ce que les personnes enfermées soient traitées avec humanité, dans le respect de leur dignité et de leurs droits fondamentaux. Si les droits des personnes incarcérées pour de longues durées ne diffèrent pas de ceux reconnus à l'ensemble de la population détenue, le CGLPL observe que, lorsque l'incarcération se prolonge, des atteintes spécifiques aux droits émergent. La " longue peine " est alternativement le temps qui rend définitivement détenu, celui qui désinsère, qui rompt les liens sociaux et familiaux. L'appréciation de ce temps varie selon une multitude de facteurs : âge, état de santé, situation familiale, infraction commise, parcours de vie et ressources de chacun. Les réactions à l'enfermement sont aussi diverses que les individus concernés. Tous partageront néanmoins une existence commune. Les trajectoires carcérales singulières décrites dans ce rapport obligent à interroger la mise en oeuvre concrète de la " longue peine " comme principale réponse donnée aux infractions les plus graves. Tous les condamnés ont vocation à être libérés un jour, même lointain il convient de se préoccuper, tout au long de l'exécution de ces peines, des conditions dans lesquelles les individus sont pris en charge et leur sortie préparée.

"This book represents an addition to the growing scholarship on the law of state responsibility in international law. It seeks to assess this body of law in a comprehensive and critical manner as such efforts have so far been relatively few. While the issues regulated by international law have expanded and diversified, as has the range of actors, state responsibility has remained a central institution of international law. These developments nevertheless motivate taking a fresh look at the law of state responsibility in order to ponder whether international lawyers need to adjust their thinking about state responsibility. My interest in state responsibility awakened in the aftermath of the commission of the abuses in the Abu Ghraib prison in 2004. International legal scholars tended to have different ideas about what state responsibility was supposed to achieve in this particular case, and by what means. At times, remedying concrete wrongs appeared to be juxtaposed with the larger concerns for legality in the international legal order. Moreover, different opinions seemed to exist with regard to whether or not state responsibility had materialized with respect to the Abu Ghraib abuses. Around the same time, the ICC became operative and promised a different approach to the most serious violations of international law. International responsibility expanded to encompass various practices and ideas of responsibility, yet, a comprehensive understanding of the developments occurring within responsibility in international law seemed to be missing"--

The number of transnational corporations - including parent companies and subsidiaries - has exploded over the last forty years, which has led to a correlating rise of corporate violations of international human rights and environmental laws, either directly or in conjunction with government security forces, local police, state-run businesses, or other businesses. In this work, Gwynne Skinner details the harms of business-related human rights violations on local communities and describes the barriers, both functional and institutional, that victims face in seeking remedies. She concludes by offering solutions to these barriers, with a focus on measures designed to improve judicial remedies, which are the heart of international human rights law but often fail to deliver justice to victims. This work should be read by anyone concerned with the role of corporations in our increasingly globalized society.
