Un système de protection des droits fondamentaux s’est progressivement mis en place dans les Communautés européennes puis, plus largement, à partir de 1993 dans l’Union européenne. La Cour de justice des Communautés européennes en a été le fer de lance relayé tardivement et partiellement par le Constituant communautaire surtout à partir du traité d’Amsterdam, le traité de Nice n’ayant pratiquement pas modifié le système de protection. Par la suite, l’apport du traité établissant une Constitution pour l’Europe du 29 octobre 2004 à la protection des droits fondamentaux a été particulièrement remarquable. Le texte contenait notamment deux avancées principales : l’insertion dans le nouveau traité des dispositions permettant l’adhésion de l’Union européenne à la Convention européenne des droits de l’homme répondait à un projet depuis longtemps formulé ; l’intégration de la Charte des droits fondamentaux dans la deuxième partie du traité lui conférait enfin une valeur juridique répondant aux aspirations jusque-là insatisfaites de doter la Communauté européenne, puis l’Union européenne, d’un catalogue écrit des droits fondamentaux. L’échec de ce traité n’a cependant pas mis fin aux espoirs suscités. Le dépassement de la crise est devenu possible avec le traité de Lisbonne du 13 décembre 2007 qui a repris de manière moins flamboyante les avancées de la Constitution européenne en se situant dans son sillage. L’adhésion à la Convention européenne des droits de l’homme était confirmée. La Charte n’était plus intégrée dans le texte du traité mais acquérait une valeur juridique par ricochet. L’échec de ce traité, rejeté par un vote négatif lors du référendum irlandais, a porté un nouveau coup aux espoirs d’un aboutissement rapide créant ainsi des remous dans le sillage de la Constitution. Son entrée en vigueur reste pour l’instant subordonnée à un nouveau vote du peuple irlandais et au dépassement des quelques divergences tchèques et polonaises qui se sont greffées sur ce blocage. C’est sur cet arrière-plan qu’un ensemble de professeurs et de jeunes chercheurs, réunis à Nice en mai 2007, ont essayé de présenter un bilan prospectif du système de protection des droits de l’Union européenne, que cet ouvrage reprend en l’actualisant. Le premier volet de l’étude est consacré au catalogue des droits et libertés protégés par rapport auxquels le contrôle est exercé. Le deuxième volet porte sur les modalités de protection mises en oeuvre aussi bien à l’égard des institutions que des États agissant en application du droit de l’Union européenne ou dans le champ des compétences de l’Union européenne. Le lecteur pourra ainsi prendre la mesure de l’ampleur de l’entreprise mais aussi des chantiers encore ouverts pour construire une Union qui soit réellement une Union de droit.

This collection analyses the place and the functioning of interparliamentary cooperation in the EU composite constitutional order, taking into account both the European and the national dimensions. The chapters join the recent scholarship on the role of parliaments in the EU after the Treaty of Lisbon. The aim of this volume is to highlight the constitutional significance of interparliamentary cooperation as a permanent feature of EU democracy and as a new parliamentary function as well as to investigate the practical side of this relatively new phenomenon. To this end the contributors are academics and parliamentary officials from all over Europe. The volume discusses the developments in interparliamentary cooperation and its implications for the organisation and procedures of national parliaments and the European Parliament, for the fragmented executive of the EU, and for the democratic legitimacy of the overall EU composite Constitution. These issues are examined by looking at the European legislative process, the European Semester and the Treaty revisions. Moreover, the contributions take into account the effects of interparliamentary cooperation on the internal structure of parliaments and analyse the different models of interparliamentary cooperation, ie from COSAC to the new Interparliamentary Conference on Stability, Economic Coordination and Governance in the European Union provided by the Fiscal Compact

The third edition of this acclaimed book continues the story of the EU's constitutional journey. The EU's constitution, composed of myriad legal texts, case law and practice, is no less of a moving target than before and the pace of change has, if anything, increased since the publication of the second edition. In a constantly challenging geopolitical context, the EU faces unprecedented political, economic and cultural trials, all of which impact upon the evolution of its constitution. In particular, the migration crisis has given rise to the need for substantial revision of the chapter dealing with the area of freedom, security and justice, and the institutional reforms embarked upon in the quest to restore financial order have taken a more structured form following the inception of a European banking union. Fully updated to include the ramifications of Brexit, the book succeeds – where others have struggled – in making sense of the EU's complex constitutional order, focusing on its essential features but taking into account the profound changes that have taken place over the past 20 years. The EU has become much more than an internal economic market. Recently it may even be argued that the focus of action has been in areas such as immigration and third-country nationals, security and defence policy, and penal law and procedure, and the work towards creating a European banking union underlines the continued need to monitor economic and fiscal policy. Eschewing too much detail, the authors underline the essential values, principles and objectives of the integration regime as well as its basic normative structure and hierarchy. In this context, the decentralised nature of the EU is highlighted as an integral part of its constitutional make-up. Recurring themes include European citizenship, fundamental rights and the rule of law. The book also confronts head-on the problems and challenges facing the Union and the gap which is often perceived between lofty ideals and harsh realities.

From the start of the European integration process, one question has puzzled scholars: what type of political association is the European Union? In absence of an agreed upon response, most scholars have suggested that the European Union is 'sui generis'. This book challenges the sui generisthesis by demonstrating that the EU is not a unique form of association, but rather a federal union of states, or what this book calls a federation. This is a discrete form of political association on par with, though differentiated from, political modernity's two other main forms, namely the stateand the empire.The federation cannot be understood on the basis of the general theory of the state or its concept of sovereignty. The 'statist' imaginary still dominates both the debates on federalism and the EU, meaning that all federal policies are either seen as 'confederal' associations of sovereign states orsovereign federal states. This book challenges this binary by demonstrating that the federation is not a 'super state' but a discrete political form with its own constitutional theory. It is characterized by a double political existence, a lack of internal hierarchy, and the internal absence,contestation, or repression of sovereignty. This book details the key aspects of federal constitutional theory and how this theory accounts for the EU's constitutional form as well as the crises it has faced in recent years.This book is broken into five chapters that cover the introduction to federalism, origins of the EU, state transformation and teleology, unity in diversity, and emergency rule without a sovereign. This book draws on a variety of literatures and historical material to help the reader develop acritical understanding of 'constitutional myths' and the theory of federalism.
