Abstract

This book examines the social and political mobilisation of religious communities towards forced displacement in Eastern Europe, the Caucasus, and Central Asia. It analyses religious strategies in relation to tolerance and transitory environments as a result of the breakup of the Soviet Union and Yugoslavia in the early 1990s, the post-2011 Syrian crisis and the 2014 Russian takeover of Crimea. How do religious actors and state bodies engage with refugees and migrants? What are the mechanisms of religious support towards forcibly displaced communities? The book argues that when states do not act as providers of human security, religious communities, as representatives of civil society and often closer to the grass roots level, can be well placed to serve populations in need. The book brings together scholars from across the region and provides a comprehensive overview of the ways in which religious communities tackle humanitarian crises in contemporary Armenia, Bulgaria, Greece, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Poland, Russia, Serbia, Ukraine and Uzbekistan.

Abstract

Since the mid-19th century military powers and various writers have tried to define the notion of belligerent occupation and, in particular, the beginning thereof. There are many situations in which a state of occupation is controversial or even denied. When is control so effective that an invasion turns into a state of belligerent occupation? What is the minimum area of a territory that can be occupied; a town, a hamlet, a house or what about a hill taken by the armed forces? This paper examines what seems to be an important gap of the Fourth Geneva Convention: contrary to the Hague Regulations of 1907 it does not provide a definition of belligerent occupation. It is argued that the Fourth Geneva Convention follows its own rules of applicability and that therefore the provisions relative to occupied territories apply in accordance with the “functional beginning” of belligerent occupation approach from the moment that a protected person finds him or herself in the hands of the enemy. Abstract

The Darfur crisis has left behind a profound legacy of displacement, with some 300,000 refugees camped on the Chadian side of the border and about 2 million displaced internally within Darfur. Despite a reduction in armed hostilities and violent casualties since 2006, as well as a peace agreement signed at Doha in 2011, limited signs of voluntary repatriation are visible from eastern Chad; where refugees are seemingly willing, but not ready, to return. Further to the Doha peace settlement, they require genuine peace to be in place on the ground, marked by visible changes in the security landscape of Sudan. In particular, they ask for the prosecution of war criminals, disarmament of local militias, adequate compensation for human and physical losses, local reconstruction, and the departure of populations who have settled on their lands in the aftermath of mass atrocities. The marked demographic changes having taken place in Darfur over the past decade, and a ‘peace’ that fails to fully address impunity and be widely accepted, make the fulfillment of these requests seem far-fetched at present. While voluntary return is being discussed nationally and regionally, refugees underscore their profound need for justice and personal safety by remaining in the camps. When and how conditions for safe and dignified return will be met is something they are still carefully considering.

Abstract

Although there has been a wide range of political responses to migration in Europe, scholarly analyses have shown that state and humanitarian responses have regardless done little to foster the integration of mobile people into host societies, resulting instead in a politics of exclusion. Resistance to such policies has taken the form of independent camps and solidary spaces. Although most analyses of informal camps agree on their emancipatory potential, the same studies have revealed that these realities can also reproduce existing relations of power. Are solidary spaces conducive to participatory politics? If so, how do activists and migrants construct their own identities in the struggle, and how do they translate them into practice? What power dynamics are re-inscribed in their action? My research will attempt to answer these questions through a case study of Ventimiglia, a town at the Franco-Italian border, and the waves of solidarity activism that have taken place there from 2015 to the present. Abstract

This research analyzes mechanisms fostering states’ compliance to international treaties. It argues that a treaty accountability network surrounds states when they commit to an international covenant and that actors belonging to the network have leverage on states to hold them accountable. This study is particularly interested in the role NGOs and IOs play as actors within this network. It identifies two main ways for holding states accountable: direct and indirect. Indirect accountability is conceptualized as mechanisms where aid recipients are empowered by organizations and will henceforth hold their states accountable. This research provides a small-N case-study on the UNCRC, maps the treaty accountability network surrounding it, identifies accountability mechanisms developed by one OI (UNICEF) and one NGO (Terre des Hommes Suisse) and examines pathways used by one state (Switzerland). Abstract

This ePaper explores the endeavours and motivations of the leading figures of the Japanese Red Cross Society, which forms the streams of the Red Cross Movement that get overshadowed in the Eurocentric narrative of its history. Using various primary sources from archives and studying the historical context of the time, the paper highlights how the main protagonists with similar backgrounds to the founders of the International Committee of the Red Cross proactively sought to establish and develop the movement both at the national and international level from 1867 to 1919. Moreover, a close examination of their backgrounds as well as their thoughts as expressed in their writings suggests that their motivations to engage in Red Cross work were multiple and in part, if not entirely, shaped by various needs to fulfil their own desire and sense of obligation. Abstract
