"This paper explores endogenous institution formation under a catching-up strategy in developing countries. Since the catching-up strategy is normally against the compartive advantages of the developing countries, it can not be implemented through laissez-faire market mechanisms, and a government needs to establish nonmarket institutions to implement the strategy. In a simple two-sector model, the authors show that an institutional complex of price distortion, output control, and a directive allocation system is sufficient to implement the best allocation for the catching-up strategy. Furthermore, removing any of the three components will make it no longer implementable. The analysis also compares the best allocation and prices under the catching-up strategy with their counterparts under no distortions. The results of this paper provide important implications for understanding the institution formation in the developing countries that were pursuing a catching-up strategy after World War II. Abstract

Searles einflussreiche Institutionentheorie gibt eine Antwort auf die Frage, auf welche Weise Institutionen wie Sprachen, Spiele, Geld und Eigentum in ihrer Existenz von handelnden Personen abhängen. Zentral für seine Theorie ist der Begriff der konstitutiven Regel. Wir verhelfen der institutionellen Realität zur Existenz, indem wir Regeln akzeptieren, die für viele unserer alltäglichen Handlungen konstitutiv sind: Ohne die Akzeptanz dieser Regeln könnten wir weder Versprechen geben noch könnten wir Geschenke machen, Äpfel kaufen oder Poker spielen. Daraus ergeben sich nach Searle wichtige Konsequenzen für die Frage, welche Rechte und Pflichten Personen im Rahmen von Institutionen haben. Die Autorin analysiert Searles Begriff der konstitutiven Regel, diskutiert die von verschiedenen Seiten geübte Kritik an Searles Unterscheidung zwischen konstitutiven und bloß regulativen Regeln und geht der Frage nach, wie man dafür argumentieren kann, dass es Regeln gibt, die für eine Aktivität konstitutiv sind. Aufbauend auf der Analyse des Begriffs der konstitutiven Regel wird eine Antwort auf die Frage gegeben, in welchem Sinne institutionelle Tatsachen als normative Tatsachen bezeichnet werden können. Diese Frage ist interessant, weil Searles institutionelle Tatsachen eine grundlegende Rolle für unser Handeln spielen.
