Dans le secteur des « communications électroniques » (concept qui renvoie à l’estompement des frontières entre les télécommunications, l’informatique et les médias audiovisuels), des évolutions technologiques et économiques profondes comme la digitalisation, la libéralisation et la convergence, ont suscité une activité réglementaire intense. Alors que la transposition des directives européennes est prèsque achevée, c’est le bon moment pour publier un aperçu pratique du nouveau cadre juridique du secteur des communications électroniques. Ce code contient les règles de droit pertinents aux niveaux européen et national. Dans la partie relative au droit interne sont non seulement repris la loi fédérale relative aux communications électroniques et des mesures qui y sont liées, mais également les décrets communautaires en matière de radiodiffusion et de télévision, ainsi que la législation connexe comme les règles relatives à la concurrence économique. Cet outil de travail pilote les praticiens dans le labyrinthe législatif du secteur des communications électroniques. Les textes réglementaires sont enrichis de nombreux renvois et annotations (concernant l’entrée en vigueur, les mesures d’exécution, la jurisprudence pertinente) afin que rien n’échappe au lecteur dans sa recherche.

À n’en pas douter, nous sommes en train de connaître l’une des mutations les plus importantes de nos sociétés, depuis les grandes inventions qui ont marqué l’ère industrielle et l’émergence de l’informatique, et ce, grâce à la connexion, puis l’interconnexion, des différents éléments du monde qui nous entoure. Après avoir d’abord cherché à nous connecter les uns aux autres, grâce à des moyens de transport de plus en plus performants et rapides, puis en réduisant le temps nécessaire à la circulation de l’information, grâce au remplacement quasiment généralisé maintenant de l’écrit papier et manuscrit par l’écrit numérique, c’est au tour des objets de se connecter, d’abord à nous, au moyen des outils de communication et, maintenant entre eux, au moyen des réseaux de communications électroniques et des algorithmes de plus en plus sophistiqués dont ils sont dotés. Les objets deviennent capables de prises de décisions autonomes ; ils sont capables d’arbitrer entre plusieurs solutions possibles et, dans un certain nombre de cas et d’applications, de le faire mieux qu’un être humain placé dans la même situation qu’eux, soit parce qu’ils sont plus rapides dans l’analyse et les solutions à mettre en œuvre, soit qu’ils sont plus habiles que l’homme lui-même. Or, toutes ces évolutions sont extrêmement gourmandes en ressources notamment dans le secteur des télécoms. Comment ce secteur s’est-il préparé à cette déferlante ? Quelles conséquences organisationnelles, légales, réglementaires, cette multiplication des objets connectés et communicants a-t-elle ? C’est notamment à ces questions que cherche à répondre cet ouvrage.
