This Research Handbook explores contemporary intangible cultural heritage (ICH) from the perspectives of both law and heritage. It questions, probes and interrogates many different aspects of contemporary ICH, including the definitions and legal frameworks designed to safeguard it. In doing so the Research Handbook highlights not only gaps and inconsistencies, but also questions the relevance of the legal framework as it applies to ICH itself. Each chapter is concerned with a different aspect of contemporary ICH, international treaties and the law, including the 2003 Convention for the Safeguarding of the Intangible Cultural Heritage. A diverse range of contemporary examples are explored, ranging from the local and global identity of migrant children, to language and the Berlin techno music scene. Taken collectively, and with its focus on 'contemporary' culture, this Research Handbook is a departure from the established discourse that tends to include some forms of heritage to the exclusion of others. The authors challenge the authority of existing legal instruments, expose their limitations and propose innovative ways in which contemporary forms of ICH can be safeguarded, whether via the law or other means. This innovative Research Handbook will be of great interest to academics researching the legal protection of ICH and the relationship between ICH, human rights, communities, identity and international trade. Le patrimoine culturel est l'objet d'engouements collectifs, mais aussi de terribles atteintes. Son champ n'a cessé de s'étendre, et il revêt une dimension immatérielle et symbolique qui en fonde la valeur. L'analyse économique du patrimoine permet d'explorer les déterminants de la demande, de prendre la mesure des coûts de la conservation et de la mise à disposition des publics, d'évaluer la pertinence des aides en direction des propriétaires privés de monuments protégés. Elle montre que les modes de financement ne sont jamais indifférents aux stratégies des établissements culturels. Ce livre met en évidence et discute l'importance des retombées économiques du patrimoine. Il décrit et analyse les politiques patrimoniales jusque dans leur dimension internationale. Entre objet de culte et objet menacé (usure du temps, négligence et guerres), le patrimoine doit une part de l'attention qui lui est accordée à sa dimension économique. Il ne faut ni la dédaigner ni la surestimer.

This book describes a research project begun by the author in 2015 and co-authored by the chiefs of the KhoiSan peoples living in the Nelson Mandela Bay Municipality, South Africa, aided by staff and students at Nelson Mandela University. The scope of the project was to investigate methods and procedures that could help re-establish the link between the Indigenous communities and their 'forgotten' heritage sites due to the colonial segregations. Making use of a participatory and interdisciplinary method we explored the tangible and intangible heritage of the Eastern Cape province, with particular attention to the remains of precolonial fish traps located along the shoreline. Included also are important testimonies from the KhoiSan chiefs who, alongside the author, led the project.
