In an age of constitutional revolutions and reforms, theory and practice are moving in opposite directions. As a matter of constitutional practice, human dignity has emerged in jurisdictions around the world as the organizing idea of a groundbreaking paradigm. By reconfiguring constitutional norms, institutional structures and legal doctrines, this paradigm transforms human dignity from a mere moral claim into a legal norm that persons have standing to vindicate. As a matter of constitutional theory, however, human dignity remains an enigmatic idea. Placées sous le haut patronage du plus illustre des juristes limousins, le Chancelier d'Aguesseau, ces rencontres souhaitent poser les grandes lignes d'une réflexion fondamentale sur le rôle de la Justice à l'aube du XXIème siècle. Cette démarche veut se situer au confluent des interrogations de la société civile et des préoccupations des praticiens et chercheurs. L'Association « Les Entretiens d'Aguesseau », après un premier colloque en 2000 sur l'éthique des gens de justice, un deuxième en 2001 sur la Justice pénale internationale, un troisième en 2002 sur la Justice et la démocratie, un quatrième en 2003 sur le Temps, la Justice et le Droit, a confirmé en 2004 sa participation aux débats d'actualité en retenant le thème de la Dignité. Soucieuse de replacer cette notion dans un contexte historique et philosophique, la rencontre de 2004 s'est interrogée sur le sens à donner au concept de dignité, tant en droit international et européen et en droit constitutionnel, que dans les pratiques judiciaires. La revendication de la dignité est sans doute un événement majeur : elle apparaît dans diverses situations, le domaine de la santé, la protection de la vie privée face aux images diffusées, le monde du travail.... Cette revendication ne doit exclure personne : la dignité de tout être humain revoie à « l'égale dignité » de tous, elle-même devant être le vecteur de nouveaux droits. Ces rencontres, qui se sont tenues à Limoges les 18 et 19 novembre 2004, se sont appuyées sur des témoignages et des interventions d'avocats, de magistrats, d'universitaires et de représentants d'associations, français et étrangers

In this volume Paul Formosa sets out a novel approach to Kantian ethics as an ethics of dignity by focusing on the Formula of Humanity as a normative principle distinct from the Formula of Universal Law. By situating the Kantian conception of dignity within the wider literature on dignity, he develops an important distinction between status dignity, which all rational agents have, and achievement dignity, which all rational agents should aspire to. He then explores constructivist and realist views on the foundation of the dignity of rational agents, before developing a compelling account of who does and does not have status dignity and of what kind of achievement dignity or virtue we, as vulnerable rational agents, can and should strive for. His study will be highly valuable for those interested in Kant's ethical, moral and political philosophies.
